Nothing bad can happen to you, only thing to keep in mind is that the next playtest might not be on steam (I didnt look into details, maybe someone can correct me), but in that case maybe Ironmace lets us play through their own launcher? I suppose keep an eye out on #📢announcements

Ironmace basically have 2 obstacles. The first being Steam's decision to maintain or overturn the DMCA takedown request. The second being if Nexon decides to legally pursue copyright infringement and a judge sides with Nexon. If Steam overturns the DMCA takedown, Dark and Darker will be allowed to remain on Steam until a court orders them to remove it.

Ironmace is allowed to use their own platform. But they can still be sued and if they are found guilty of copyright infringement, they can still be required to cease and desist, pay damages, hand over profits, and delete offending content. As someone who owns the game that was obtained legally, you would not be at fault of anything. The servers would be shut down though.

I imagine they are assuming Steam will overturn the DMCA claim. That claim seems incredibly weak on all counts as long as their code is actually original. No one can be sure of the timeline of if or when Nexon files a suit and how long the suit will last until it is confirmed and concluded.

Cease and desist letters are commonly used as a scare tactics, to initiate settlement without filing suit, and to warn of impending legal action if the offense continues.

We do know that Ironmace isn't just giving up. It seems very unlikely for them to settle given their stance and position, but it is possible and may be worth pursuing in the grand scheme of things.

Wait for official announcements is the best answer. Everything else is just speculation.

If Nexon can prove that Ironmace illegally created Dark and Darker using their legal property, they would absolutely be in the right. As soon as they provide legally verifiable proof, I would be here defending them instead. Until they can prove their claims, Nexon's accusations are just accusations and in some cases conflict with their own accusations. "Saving the good proof for court" isn't a real thing and they are already in court suing Ju-Hyun Choi.

Basically every single game studio consists of former employees of other game studios. That's standard practice in every single industry. Nexon directly accuses Ju-Hyun Choi of unlawfully transferring and disclosing P3 files and provide no official documents, just 3 bullet pointed sentences that don't even mention disclosure. Nexon even claims the impossibility of Ironmace's ability to produce Dark and Darker within the time frame it was without stealing with no proof. Nexon is consistently all accusations and assumptions with no proof.

Nexon claims they took reasonable measures to maintain confidentiality of source codes, art resources, and build files including Nexon's Agreement for Commitment to Data Protection. They then state that Terence Park, the head of the sub-team for P3 Project presumably since it's development starting in August 2020, did not sign it until August 5th, 2021 (The specific date that P3 was revealed to the public via the Gematsu.com and Donga.com articles), and only 4 days prior to his leaving the company. The Donga.com article state Nexon's Vice President Kim Dae-Hwon refers to "'P3', an adventure in medieval dungeons with friends" and both articles showcases the infamous torch screenshot that was used in the DMCA claim and is actually cropped in the DMCA claim to hide the fact that it shows the number of survivors, kill feed, and makes hand placement appear to be more similar than it actually is by additionally cropping their Dark and Darker image from Bandisoft.com.

It's actually a pretty cool and fun idea. They could go a lot of different ways with it as well. They could have them provide different buffs that otto gives you in the tavern they could be relatively negligble like +1 hp or have similar negligible tradeoffs like skins, +1 armor/-1mr. They could even just have them be purchasable from the tavern master as a gold sink and make Otto just do different tricks or even have cosmetics or titles for X number of treats fed to Otto as something for people to chase.

I think it would be cool to have Otto tag along in the dungeon if you give him enough treats, he’d be unkillable because doggie immortal, but would do little things like help with pve and slowly gather loot, maybe even sniffing out secrets 🤔

Best way I can explain is it that, 1 I can't see how that'd really fit at all in DaD setting, and 2 if you really cared about being represented you don't need a digital flag to validate your choices

Painting armour and putting cloth surcoats and stuff over your armour to customize them was actually fairly common in the medieval period both for identifying allegiances and just to look cool. unfortunately historians very frequently used to clean up armour because their and our fashion sensibilities are a lot less garish and colourful than theirs were back then.

As far as we know, yes. Nexon put out a DMCA on the 24th and IM (we presume) responded to this on the 26th as that is when they posted their response in the discord. According to steams DMCA policy, the complaint filer has 10 business days to pursue legal action. Which would be tomorrow the 7th assuming IM posted their counter claim the same day they posted their response in discord.

I'm pretty sure you can't submit a DMCA for the same listing twice like that. It's different for like Youtube with people having multiple videos but you can't just keep sending a notice without actually filing a lawsuit. DMCA system is broken but it's not THAT stupid.

You cannot continuously serve DMCA notices. After a DMCA claim and a DMCA counter claim, Nexon must file suit, serve Ironmace, and then meet with and petition the judge to issue a cease and desist order, who then must agree that the argument is so strong and will cause so much damage that they must issue a cease and desist order without meeting with Ironmace. In most cases this does not happen.

"If you decide to DMCA strike down..." makes it look far more simplified than it actually is. There are quite some formal and content-requirements if you want to issue a DMCA. On a semi-moral, this boils down as in the DMCA statute, that the issuer must act in "good faith", therefore with actual belief that copyright had been infringed. Not just for the sake or fun of it.

There is no timeframe to sue after a DMCA claim. Nexon doesn't have to sue until before the statue of limitations timeframe is over. The US statue of limitations on copyright infringement is 3 years from discovery. A DMCA takedown request is very similar to a Cease and Desist letter. It's more of a warning where an offender can just stop and walk away or continue and face the possibility of being sued, although there are more legal ramifications of filing DMCA claim because of benefiting the accuser so heavily.

Nexon cannot make the same DMCA takedown request to remove DaD from Steam, they must sue and then convince a judge to order a Cease and Desist with evidence while Ironmace defends themselves.

The DMCA provides a remedy for bad-faith takedowns, specifically:

Any person who knowingly materially misrepresents under this section—

(1) that material or activity is infringing, or
(2) that material or activity was removed or disabled by mistake or misidentification, shall be liable for any damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by a service provider, who is injured by such misrepresentation, as the result of the service provider relying upon such misrepresentation in removing or disabling access to the material or activity claimed to be infringing, or in replacing the removed material or ceasing to disable access to it.

There has to be a minimal amount of evidence that you own copyrighted material to make a DMCA claim. It doesn't have to be enough to actually successfully make it to trial. It's a low bar on purpose. But you can't get there with literally nothing.

Basically you need to convince steam that it would be prudent for them to wait for a counterclaim. Meanwhile, you are supposed to follow up with a lawsuit as @unborn basalt describes to permanently stop the copyrighted content from being published. DMCA is very filer friendly by design, but you're not meeting your burden with a MS Paint jpeg.

We have no idea if the playtest will happen as scheduled until Ironmace specifies one way or the other. They are not required to have the playtest. They might not find the playtest worth the resources required. They may opt to go straight into Early Access. They could even be negotiating with Nexon.

We do know that Ironmace has consistently tried to be as open and respectful as possible to their playerbase. If they have already decided to postpone or cancel the playtest, it's hard to imagine that they wouldn't just tell us unless there is a very pressing or legal reason that doesn't allow them to. They know people are scheduling vacation days, content creators are trying to make a living, and hundreds of thousands, if not millions, of people are dying to play the game. They could have easily quelled the countless "when next playtest" or unnecessary pings or what must be an incredible amount of stress if their intention was to cancel or postpone the playtest. What benefits would they get from stalling as long as possible? I can't think of any.

thats not rlly how it is going. First, its not that it would "jepordize their case" Not even sure if Nexon has made a direct lawsuit against ironmace, however either way them announcing weather the playtest will take place or not will not jeopardize there case. It is currently based on the DMCA and getting the game back on steam/ some other launcher. From what I know the DMCA will go down, and then the game can be put back on steam unless Nexon sues or renews it. At least I am pretty sure, correct me if I am wrong. But the playtest is not based on an ongoing case, it is based on if they can get the game back on steam, or use a different platform/make there own to launch it. Ironmace just doesn't know if it will take place yet or not. It is all based on getting it back on steam.

It’s a legal matter if my understanding is correct. Their lawyers probably told them not to say a single thing until, according to everyone else the 13th. Anything they say could probably be used by nexon in court, so they have to be careful with anything they say. Therefore easier to just stay quiet. It makes sense.

There will surely be a playtest happenning tomorrow. The only reason Ironmace hasn't announced anything is due to the rapidly increasing hype over the game. Having hundreds of thousand of people up on their toes over a single product is something any small company such as Ironmace would dream of. If Nexon hasnt filed a lawsuit to this point, which they have not, and the period of the DMCA is over. It's a clear sign the playtest will be happening, they just want people to sck their ccks on the server.

I keep seeing pushing the day of the DMCA counter response back more and more lol. It doesn't make sense for them to send it any time past the 28th. They said they were just waiting to release stuff to the public after their lawyers checked and told them what sensitive info needed to be left out. Which means they must've had it all ready sometime before they published it.

Valve just drags their feet on DMCA shit for some reason. The Workers & Resources game got taken down by a 100% bogus DMCA claim, which they likely didn't need to write a lengthy response to, but it took 20+ days for it to come back on steam well past the hold time.
