Depends though, what happens if I generate an image but then touch up the image and change it to be slightly different, is it then not mine? (In situations like midjourney where you gain commercial usage with a sub)

It's a weird grey area, if I ever make an image 99% of the time it needs at least a little tweaking it's almost never perfect out of the ai box

If you want some perspective: Developers (like myself) have these kind of tools since months (roughly a year now I think) and GPT-4 is amazingly good at coding. It is awesome at helping with all this tedious work, which needs to be done but just eats time. However, while it is pretty good at the basic things, it falls apart at completely niche programming languages and topics and the code it writes is not the most performant. It kinda writes like someone who just graduated. I think you‘ll see similar things as a designer: It helps enormously at doing all those time-consuming works and allows you to focus on the creative stuff. Also: The images shared from Firefly are amazing - but they still need some (human done) corrections or finishing touches.

Firefly is trained on licensed or copyright-free content. if the style of your favourite artist is covered by this requirement, then there is a good chance you can ask Firefly for that particular style. The Content authenticity initiative is also working toward a universal “Do Not Train” Content Credentials tag that will remain associated with a piece of content wherever it is used, published, or stored. Firefly creators will be able to apply this tag to their work to opt out of including specified pieces of content in generative AI training models.

Also, some anecdote: Today GPT-4 helped me do some tedious data analysis. However, it was not perfect and the errors from the IDE (think Photoshop but for programmers) gave me errors. GPT-4 did not know what do with the error, however, I am knowledge enough to know what these kinds of errors are and how to fix them. I guess something similar also applies to you: You do know how to gradient, you know which things should be focused and what looks good

If I simply use Firefly to generate a background, but then draw a character on top of it, I isn't exactly accurate to say that the overall work is AI generated, so I wouldn't want that tag to persist over the whole work.

@dylis yes its similar, and Adobe already has a lot of ai tools in photoshop that I use for editing photos, sometimes with great results, and sometimes I still need to do the edits myself. But now with Firefly it's generative ai which is going to be even more of a time saver.

It is...complicated. I'm not a lawyer, but this is my interpretation of the rules. You essentially need to show that you are the mastermind of the work. So you have to be able to show that you had a part in the works composure or artistic elements such that it couldn't have been created simply by the AI alone. So it really comes down to a case-by-case basis.

There really isn't a good solution, so I respect the USCO for doing what they can. If they had allowed AI works to be copywritten by default, like any other art, someone could just make a random prompt generator to spit out and register copyrights on art, blocking everyone else out.
