Also if the images were made in Photoshop beta then no watermark is added there.

Here is the official guidance:
For images produced with GenFill in Ps it is okay for you to share without including a watermark. You do not need to add a watermark, but it would be great if you did.
Images produced with GenFill on the FF site should include the watermark. Basically, you should not remove watermarks from finished images.

Also any images made in the PS Beta using gen fill or with Firefly are not to be used commercially images can still be traced back to firefly with content authenticity, even partial/cropped images, or screenshots

There are some "super prompts" for chatGPT with wich you can make it do certain things that normaly won't work. Those are very long and detailed. Those might be a candidate to at least be up for sale, but not sure how copyright would work there.

Quick question! I am an author and my book is very fantastical and imaginative. It is also educational. I wanted to use Firefly to create some possible ways to imagine this crazy world. I generated some very interesting images! My thought was to write a series of social posts highlighting and discussing AI as a way to visualize such imaginary worlds.

My question is: Is this considered commercial? It doesn't seem so to me because it isn't selling anything but since it is about a book that is sold I thought it good to check.

this is tricky. writing about Firefly and using images as examples would be fine. For example "this is the interface of firefly and here you can see an example image". In other words: Tutorials are okay. But using Firefly generated images for storytelling, when those images could've been traditional art, would not be allowed if you are planning on selling the finished work.

Here’s the result of an experiment.

I started wit a simple prompt asking fo the portrait of a detailed steampunk robot (image on the left).

Then I uploaded it on the beta version of Photoshop and used generative fill to expand the image and create more detail, experimenting on it with different generative fill prompts/styles, until I got the image on the right, which I believe is a fine end result. I also changed several details using traditional Photoshop tools, to the best of my abilities, included and substituted elements found online, trying to create something a bit more cohesive than the simple “swirls” generated by Firefly. Here are still elements that lack cohesion, but for the purpose of this discussion, I’ll stop where I am right now. This process took me a bit under three hours. (1/4)

So, what’s the point? Well, I guess there are a couple.

First of all, generative tools can (and should) be used as starting points and tools for a longer development, and not as ends on themselves. It’s extremely rare that I can generate something that sums up my vision of an image, and when it does, it’s usually a simple object or a scene with little or no detail. Most of the time, there is a considerable contribution from my part to add detail, change what doesn’t suit my vision, and generally transform the image. What I mean is: generative tools should be exactly that: tools. They should help us be better creators, and not just substitute us in creating. (2/4)

Second, here is a question: after spending hours adding to and changing the image — several times with the use of generative tools, but not all the time —, striving towards a vision and achieving it (Well, say, 90% of it), how much of the final product should be ascribed to generative tools, and how much is a product of the creator’s creativity? Granted, I would have been completely incompetent to reach this result using Photoshop and Illustrator, which means that there is a lot here that hasn’t been created by me. But this exact result wouldn’t have been reached using simply by asking Firefly to generate a cyberpunk robot holding an apple, no matter how intrinsically detailed the prompt. So, how much “copyright” could/should a creator claim over something like this, a multi-step composition achieved after a lot of iteration, trial, error, adjustment, etc? (3/4)

I undestand this, to be sure. I have been prompting generative systems since I first got to beta-test Dall-E 2, early last year. I get that prompting is a large part of it (and pompt engineering a profession on the rise).

I am not making the point clear, and I apologize for that. As has been shown on these last few posts, it's simple to create a steampunk robot holding an apple, but how many people coaxed their creation to something other than what was originally generated by Firefly? I added as I saw fit, I changed, I substituted non-cohesive "parts" for chesive ones. To the point where the final robot is not simply the result of a prompt, no matter how elaborate.

My question is about authorship. Are any of the robots posted after mine a creation of the authors beyond the prompts? (and does it even mean anything that it's possible to go beyond the pompt?) Thanks for this discussion. I just re-read the terms and conditions, and for Dall-E 2 they go the furthest, assingning rights to the output to the creator, but just that (notice they don't "transfer", but just "assign").

So, yes, we are just commissioning art, not legally creating, even if technically we deeply embed ouselves in the process.
