So, if you in example fails to yield for approaching vehicles who have right of way and you "didn't see them", will not get you out of the ban, as you're supposed to yield and check for any approaching vehicles. The same thing, is when you do lane change. You have to check for any vehicles next to you.

As of you getting ban, other doesn't. - This is not entirely true. Yes, there is players missed through specially in-game reports. But, they can be caught later, with other violations or someone actually reported with video footage, for website report.

before the game overlay opens you have to make sure there are no other windows tabs opened, so only the game windows should be running , alternatively you can press ctrl + win + . or D (from your numbpad ) then head to task manager and close all the overlays(programmes) that are running besides the game then your mouse cursor should be fine after that.
