That cannot apply in an overtaking scenario, because they are not in the space in front. The Skoda would be found at fault with irl regulations as they would have either failed to signal, or failed to ensure that there was no hazards before switching.

Regarding maintaining space. The problem isn't in front... its the side, there's not enough room to make space nor enough time to react.
