Yes, that is the wording of the license agreement, but nitpicking legalese is best for the lawyers. They love to play word games. The marketplace FAQ says:

I think the prevailing wisdom is: for the sake of a few hundred bucks, it's probably worth just buying multiple copies and not risking your project.

I do see that link you gave is pretty clear about it, however that site is not officially part of the EULA. So, email marketplace for clarification. The FAQ could be considered where it defaults to a per seat model imo. The license agreement is the license agreement allowing it either way, and then the marketplace FAQ clarifies that. That in my view is no less valid than a marketplace plugin containing a line in the description "This is a per-seat purchase" which i'm not even sure the marketplace would allow since they are in control of the licensing on the marketplace

AI is the new world now
afaik the rules regarding plugins haven't changed. Plugin licenses are per user, this is a floating seat meaning anyone in the company can use it, just not all at the same time. If you need multiple people working with the plugin at the same time you need extra seats. If the MP team say anything different, get them to double check with their line manager. I had to push the email responders to get solid answers on these things previously.
License is not floating, it's per user not per seat. As per the Plugin Warden(which states that its intended scope is to prevent accidental violation of license) functionality in the engine, entitlement is checked per user(email) that purchased it. So technically there is no floating functionality for single or concurrent users (except if you can login with the same email ID in launcher at multiple locations, which will enable the floating licenses, but sharing accounts is prohibited as per TOS "You may only access the Services through your own account").

Maybe in 15 years from now, when we`ll get an improved marketplace, we'll also get clear and concise EULA that states exactly what it is and what it is not.
To have a multi-user purchase, the buyer would have to contact marketplace team, pay the amount for the licenses, but that's an exception, additional stuff, not part of EULA. It's like a side thing, this also is very unclear and shouldn't be a thing. And that's why almost no-one does it.

Indeed, as it seems to be the case that the Marketplace Team even when pressed for clarification. I emailed them, specifically asking about multiple purchases and if it was a floating seat or not. I was most assuredly told that they can give discounts on bulk purchases and that the seats were indeed floating. It doesn't surprise me in the least that either the T&Cs page hasn't been updated or the team I was in contact with were given the wrong info. This was about 2 years ago now though, maybe things have changed. They'll probably update the T&Cs in the next launcher upgrade... 😄 😄

so as a parenthesis to the above discussion, on my main product page I stated clearly that the purchase is per user, non-floating. purchase validated through Plugin Warden(launcher). To prevent any misunderstanding or misuse.
and unfortunately, even though the marketplace team was with good intentions, it's not what they want to be, it's what the lawyers and law says it is. So I'd doubt any legal advice

Yeah, even though, the only thing that matters is the TOS, T&C and EULA. Things you have to agree upon buying or selling.
And unless they clear the air there, the rest doesn't matter.
the license is floating as in your purchase is not machine locked. but is still bound to named user. so theoretically, still only you are entitled to use it.
and this is why they should implement multiple license types. let the publishers decide their license terms. like all other stores.
very grey area. that's why better to avoid all this, and purchase for every user that uses the product (where applicable of course). only companies would find a use for this so the purchases have deductible taxes in most places anyway.

And interesting that you state on the store page that it's licensed per-user. I thought about doing that, but assumed it'd be against the stores policies to list any licensing conditions since they control the license

I just emailed marketplace with a question to clarify whether i can add a similar line. I have a client that absolutely cannot have telemetry etc included, so I'd prefer not to have include PluginWarden, but I may have to reach out to them and offer a custom version

it's pretty clear for you. for others it's not. they don't know plugins are per user. they think they buy it once and everyone in the neighborhood can use it. I'd rather link the EULA and state that plugins are licensed per user. can't do no harm.
If you want/require this to be compiled for your asset to function, it will need to be a plugin. If you are including it as an example as an additional file, it is probably fine.

Looking for opinions: Do characters rigged to the Unreal mannequin but not sold with unique animations themselves sell? I'm not much of an animator but I'm planning on launching my first asset on the store soon and wondering if I should hold off and spend a week making some basic animations first or if it's a big deal.

Hey i was wondering why AI created packs accepted in the marketplace? i just stumbled across an anime avatar pack and from what i can see at least 12 are (almost) exact copies of genshin impact character and other animes.
one of my product got rejected last time because it was deemed "too easy to recreate" but aren't these AI packs made with free tools also easy to recreate?

we can now check a tickbox to make sure our assets cant be used for AI purposes.

I'm just setting up my project file for my first Marketplace asset (a rigged character with some accessory models) and I'm wondering if it's a good idea to set up a demo player character or if that's just unnecessary bloat. I've noticed in a lot of humanoid character assets the third person template character is included and the character sk usually has the animations retargeted to it. Is this common practice?

Anyone ever have an issue downloading something off their library and it won't function properly? I have 3 assets atm that don't load properly or even compile shaders for that matter. When it was working last night. Not entirely sure what to do tried clearing cache, tried reinstalling new versions of the asset in attempt to fix it. Even looked on google to see if anyone had a similar issue couldn't find anything. It's strange as the project loads but none of the assets inside function or load properly.

More the assets on the MP, more the noise/garbage. They won't go away, what we need are better tools to surf the market. And this ain't happening, because Epic is famously bad at their MP tools (e.g. Launcher).

team members, freelancers whoever cannot use their own assets in anything other than their own projects. You can only share assets to team members etc so that they can be use in and only in your projects.
Contractors can't provide assets. My understanding is they need to be bought by the business and shared down to employees and contractors.
Otherwise you could have a contractor that bought every asset and they just contract one day to any project and all those companies get a free copy. Doesn't make sense.
The more interesting one is your personal account and your business account. I agree it depends on your business type. If your business is a separate legal entity, presumably the business account needs to buy it. If you are a sole trader/individual, it's probably ok? In either case, when in doubt ask the marketplace via a support case.
Aye, in this case it was a contractor that had the Ultra Dynamic Sky asset pack, bought with their own dime before we even started working together and they added it to the project.
As for my personal account to my business account, it is a separate entity. I ended up finding a free cave pack on the marketplace so I could skirt around the issue haha
In both cases then I'd just purchase the assets in the business account to avoid issues. At a minimum UDS, and swap out your caves to the free asset. But again, when in doubt, ask marketplace
How can you even enforce this? i feel like all of this comes down to your own morals to "follow" said rules... its just nonsense tbh
Ok, let's flip that, let's say you are a business, you are hiring multiple roles and you try and skimp on a $50 asset. 1) a copyright claim could get you removed from steam or iOS, pretty big risk, and 2) what if you need support for that asset and not having a valid license costs you a day of people twiddling their thumbs because the author won't provide support without a validated purchase. That's significantly higher than the $50.
It's not just about morals, it's risk v reward. Assets are SIGNIFICANTLY cheaper than wages, its cheaper just to buy the asset than eat the risk of either of those outcomes
i know, from a serious business sure... but lets be real, a marketplace asset creator cant come up to any game released on steam thats using said asset and ask them for a receipt of the purchase... thats nonsense
not to mention that if you use unreal and get a serious success, epic has many ways of checking if the content in the game was purchased by that company.

For plugins there's a plugin warden thing you can use which validates license through the launcher. It's harder for assets, sure.
My feeling though is the vast majority of people and companies buy it properly. The ones pirating imo are likely hobbyists that would choose a multi week long free approach to a problem vs buying anyway, so they aren't a lost sale. The few remaining companies that run the gauntlet, well, can't do much, best you can do is offer incentives to get it for real. Updates which may not filter through to the pirate sites etc

I had actually planned on buying that and was sad to see it can't even be purchased anymore, people it seems complaining about lack of interest from the publisher to continue to fix things and push updates, I just wanted to strip out the basic animations for retargeting, could care less about the blueprint stuff, but apparently I can't even do that now because it was flat out taken off the store... concerned now what other things I've purchased (or not yet purchased) can just disappear like this

It's not a debate of true or false, it's fact. When someone purchase something on the marketplace, they purchase it from Epic Games which purchase it from the publisher. Epic don't purchase the entire product permanently and own it, but for that particular sale they make, they basically purchase from the publisher and sell it to the end user. That's how it works.

Yes, it is a risk unfortunately. I don't think there is a foolproof way for epic to solve this. Ofcourse, they could respond to complaints or allegations quicker which may mean less people get caught in traps, but then that opens itself up to a different type of abuse, like DMCA strikes on YT which are commonly abused against creators.
Best you can do at this stage is vet anyone you buy off. If the price is too good to be true, or if they release an absurdly large amount of content in rapid succession you have to wonder where it's coming from and if enough due dilligence has been done on their side.

Honestly, I found that hard to read. Having a tiny portion of the screen for text isn't great. Having large pictures is great, but you need to treat text the same way, give it the same kind of prominence. Be careful about using colours in text or as pointers etc, assume colour blind people might use it. Bonus points for actually having documentation though.
The associated discord post from the Forsaken devs point out that some facts about such things. They do not say anyone stole anything.

Well there is a "Naming Convention" section in the guidelines, but as with most guidelines, it's very shallow and enforced based on reviewer's mood and other astral cycles.

I downloaded 5 different assets of houses all with the CC Attribution license. Took the roof of one, and the windows of the other, the material of the other. Added some more detail and changed it a bit. And built a new house. Then added other houses from other authors. And built something like a small village.
Since all of these assets are under the license CC Attribution license. So it says im allowed to edit, copy, resell, and use commercially.
Is it okay for me to sell this asset now?

Hello everyone - by any chance does anyone happen to know of a solid NPC spawning system or component that I would be able to leverage effectively in an open world game?
I was looking at Population Control, and while it has a lot of the stuff I would like, one of the major drawbacks from it (and a major requirement for me) is the ability to pass values to an exposed variable to the spawned BP.
Ideally, I would be looking for something I can place into the world (through the map view editor or through blueprints; either one is fine) but can access and manipulate settings related to the spawning bit through blueprints (most critically, being able to tell it to spawn my NPC base class, and then pass values to the newly created character)
@rose lagoon - Honestly, it isn't bad, and seems solid for the spawning piece. But still not sure if that would allow me to add variables exposed by spawn to an NPC blueprint spawned by this.

No idea. Personally I would advise just getting any free assets and using those. You'll most likely to run into issues if you don't know the engine very well, so I point you towards the pinned messages in #ue5-general
you can worry about using more appropriate assets when you actually have a game to use them in.
The Epic's Sample projects and the official Learning portal is a good start.

I just wanna say something to any potential Asset makers-- please show clear screen shots of your wireframes on your meshes in your images. If we wanna buy assets to speed things up... and we think your stuff looks really good and could incorporate into our game along our own assets, if you have no wireframes to show your topology... we're just gonna pass by your content and not buy, and buy someone else's. Telling us your vert count without showing your topology tells us nothing about how those verts are potentially distributed. And we're not gonna buy content that potentially has to be re-done. 🧐
And ye, I'm a real stickler for artistic consistency. 😛
But you can usually tell, if it's dubious quality the topology will suck. Good looking assets will for sure be properly made
Nah, there's some things you really can't. It isn't about 'dubious quality'-- it's about, "I have a scene with a certain degrees of bevels, edges, etc... and if I can't see the wireframe of your model I don't know how yours will actually blend with mine in an actual scene."
And if you put two models of different levels of fidelity side by side, you WILL see the difference.
That's not related to topology though, that's just a style/quality thing
Also, if I need to retexture or UV map (because you'd be surprised how bad some people are with UV maps)... I don't know what's up with their topology. Is it gonna be an easy job, or a nightmare?

So this is probably a dumb question. I released a character asset about a week ago and I'm just about finished with a second one. I was wondering if I can just use the same Unreal project, replace the assets, and zip it up, or if each asset needs a separate Unreal Project. I guess I'm mostly concerned about the name of the project.

It's doable, but before doing that you might want to assess the consequences on the customer side. If a customer bought your 2 characters and added them to a project, would they overwrite each others? Or would only shared/common assets overwrite? Would it work properly?
If you're sure that it would work properly, that's actually a good way to avoid duplicate assets. If you have doubts, just rename your project's main Content folder and it should work.
None of the assets should be named the same, so I don't think that will be an issue. But a very good point to be on the lookout for.

Depending on the asset type, it might require a specific version of the Unreal Engine. So say it is a plugin that requires 4.9 and you have only 5.1 installed. The Launcher will say it is "unavailable".
it occasionally might take a while before the confirmation of sale goes into the database. can sometimes be near instant, sometimes it takes a short while.

The contents of the Unreal Engine marketplace is full of great stuff... locked behind a lacklustre interface. Enter Orbital-Market, an open source and free front-end alternative and search engine over top of the UE market... that is MUCH better.

umm, that can be trivially read by the client or network administrator with netstat -a to see active connections, and transmitting a public IP is perfectly fine since it's by definition, public and will be included in any IP packets that your game users to communicate with the other party, meaning literally every time you talk between games there will be many IP packets(all of them infact) that contain this information

SSL for in-flight comms to your backend, and then your database likely supports encryption at rest directly
im kinda stupid when it comes to networks and all that (why im using firebase), so im not exactly sure what that means
so talking to your backend will likely be over a HTTPS connection which is encrypted
and most databases support encryption already without the need for a plugin. The game will have no need to decrypt it as such, as it will be decrypted coming out of the HTTPS tunnel

That literally has nothing to do with the marketplace. As the earlier report linked at the beginning of the article states, there seems to be some actual corporate espionage happening, with ACTUAL stealing of assets and headhunting personnel, not buying an asset pack off a bad faith merchant.
Yeah. short version: The people behind Dark&Darker worked at Nexon while they were developing an IP similar to that game and Nexon decided to discontinue it, while some developers didn't seem to agree with the decision. They are being accused mainly for stealing code, even if the art is strikingly similar too.
Okay so I have a question. I realize that launching any type of game is not possible without the licenses covered. I have heard many stories earlier that some actually did and all they did was a slap on the wrist from the author and epic, and then they just bought the items they needed to.
Now the question is, is it somewhat of a grey area to build up a whole game of content that is not "owned", like several sites offering pirated assetd and the likes and all ok if before releasing purchasing it? Needless to say it's a lot easier to prototype like that. I am really planning to pick up the retro sci-fi futuristic city, as I don't want to spend 300 on it (just yet). It's not a grey area in any way. It's still a violation of copyright. Its just plain ol' piracy. One of the main financial benefits of assets is rapid prototyping. So no, it's not fine to pirate them and only buy before release

While according to the eula all assets are shareable within the team. Not that one. I don't know the asset you are referring to, but generally assets are licensed to an individual or company. They can be shared by the company to employees or contractors for the purpose of working on a company project, and that's it. Plugins though are licensed per user. The company would need to buy an additional copy for any developer using that plugin.
Pretty sure a company as big as Nexon would also make you sign contracts, NDAs, non-competitive claus etc, when you start working for/with them

Even 4 months ago, our team could use meshmorpher without getting an error if a second user from the same epic account wanted to use it concurrently. Now, not anymore. But it's ok, we are past that part of development but it's still uncomfortable.
I think it's more likely that they'll just shut it down as a lesson to people who steal their content.

I think it was the meshmorpher dev that told me about the plugin warden. It's included with unreal and MP recommends it if you want to protect against users accidentally exceeding the license

Yes and there's a bit of an intersection of contract law and copyright law here obviously which complicates it. But generally speaking if a copyright is unclear it defaults to being copyrighted. If you release a movie without a copyright notice or license notice that doesn't mean it's public domain, that actually means no one has the right to share, distribute or even watch it

In some cases successful pack authors get an email with the request for free of the month, and obviously one can decline those.
depending on the pack, 7500 is either great, or a slap in the face.
also considering the amount of sales afterwards will drop quite drastically, and --again depending on the pack-- might stay low.

Yeah. I have no opinion on the matter, I just don't think that's any sort of evidence that using the marketplace is a risk. The issues there are clearly more about bad blood and existing matters. The marketplace asset filenames being referenced are a very small part of the overall issues in question

It's more complex than that. It's about trade secrets. And if the team were working on a game very similar to dark and darker before it was cancelled and then went on to work on dark and darker, even if all the assets were bought from the mp, Nexon still has a valid argument that the team could only have made the dark and darker game as it is now, because they worked on the P3 thing

Valve did not, and do not look at the contents. DMCA claims require companies comply within a reasonable time or face infringement claims themselves. It's not valves responsibility or ability to judge the merits of a DMCA claim

In this case it seems more likely they both bought from the same seller, but theres a WHOLE bunch of surrounding factors, like customisations made, and a whole bunch of bad blood from a terminated employee who seemed to copy files to a home server without authorisation as well as poached other employees to create essentially a clone. The assets listed on the DMCA are irrelevant, they would has issued a DMCA regardless of the same asset pack due to ongoing disputes. it's just one hook they've used

Epic handles all VAT. It charges it(it's added to the product price, where applicable) and remits it to the proper institutions. When you get paid by epic they don't send you any VAT that they added to the final price because they handle it. You only need to handle your local income taxes.
If they didn't do that, selling on the platform would be a nightmare and only sellers with accounting departments would be able to handle that amount of VAT/TAX registration and remittance. Took me a while to understand how this works but hopefully I made it clear for you
Basically how this works, when someone wants to purchase your product, they send the order to epic, epic buys it from you, and then sells it back to the customer.
If they didn't do that, we'd be doomed because international sales are a pain. VAT remittance is no joke.

sorry, VAT is only in Europe. For States and Countries that Doesn't have VAT but their equivalent, is called Tax. Same happens there.
so if a customer from outside of EU bought your product and in his country there's an added tax, then it will appear in Tax column based on what that tax is in his country. Still charged and handled by Epic.
That's the advantage when selling through Epic Marketplace. You don't have to care about all this. It's good to know it, but you don't have to care about it
The only thing you need to care is to pay income taxes and dividends taxes to your local government which is easy to manage.
If you had multple units of the same product sold in one day, you'll see that in some cases both vat and tax are filled. That's because some of those buyers are in EU and some are outside EU 😄

Yes, but DMCAs tend to be fairly effective because if it's not enforced the hosting party becomes liable for the infringement too. So hosts tend to just enforce them and wash their hands of any drama. It's a bit of a loophole where the host can keep turning a blind eye to rampant infringement as long as they act quick on DMCAs
but regardless of being a loophole, it has the effect that DMCAs tend to be acted on

Having worked in big studios, most of them are so risk adverse that the mention of pirating software or content or frankly even buying content from sites such as Unreal Marketplace is a major no.

plugins need to be submitted per engine, but content seems to be just submit your oldest supported engine, and tick any newer engines. Depending on your content though, you may want to have a different version for newer engines with the newer materials, or nanite enabled, etc

A few months ago, I bought a massive SFX pack on a discount from an author who call (him/her)self "Sidearm Studios". It was a very suspicious $14.99 for the amount of content included but at the time I didn't think of it much so I bought it. Recently, it has come to my attention that the massive SFX pack that was supposed to be receiving regular updates now and then was unlisted from the marketplace. Since I own the asset, I was able to get back to the page and when I went over to the comments and reviews, I was shocked by the news that some of the effects in the pack were in fact stolen. I went to Sidearm Studios' profile and also noticed that about 70% of their sfx packs are no longer listed on the page. It appears that Sidearm Studios took them off before Epic noticed since I don't remember ever receiving an email from Epic regarding the illegal pack that I bought.
What a fucking waste of money.
Note: Sound effects aren't cheap.
Sidearm Studios also "makes" 3D assets and though there's no evidence so far of any stolen assets, they have a suspiciously priced "Complete Environment Bundle" which they sell for about 30% the cost of all the individual asset packs in the bundle combined. If I were you, I would avoid this author for the foreseeable future.

It's better to do so, but it's not required by Epic.
I just keep it in line with the semantic versioning I use for the rest of the plugin
helps with debugging, since sometimes you can just ask users to update when you know you've already fixed a bug and you can see that they're running an out of date version

However if it's your project/company you could buy the extra copies required to cover the users
If it's just a local only editor plugin like blueprint Assist you can set it as optional in the uproject file which will not cause any error messages to appear if someone doesn't have it

problem is, almost nobody leaves reviews, and most are on the free for the month and epic's own packs, so that would be warped.
Could just exclude epic's own packs and free for the month. There should still be a correlation between number of reviews and number of sales even if the reviews are much fewer.
There are also some products that lock documentation behind 'verification' done through reviews and questions, so it's not a particularly accurate metric to judge popularity

They get payed via hyper wallet. And it's paid 30 days after the end of the month. So Feb gets paid at beginning of April, March gets paid at beginning of May.
Depends how you set it up via hyper wallet. Log in to your account to check your settings

Ok so i recently made a package for marketplace and it's my very first one and i have so far learned a bunch of stuff so i was thinking i should make a series on YouTube like a vlog/documentary style of my journey of being a marketplace creator showing what decisions of mine are helping eith more sales what is not working and the process of making the asset pack and etc...
So i wanted to ask, what such a series should be called?

bad news.. After opening and closing the project a few times a notification popped up that project files were out of date and prompted me to update it. When i hit yes to update, it added the engine plugin into the project. I did a diff of the change, and the only change was the plugin added.
I reverted the uproject file, then opened it again and it prompted again =/
Not sure why it waited a few cycles to start prompting this rather than immediately.

I'm thinking about creating some code plugins for the marketplace. Is there any way of finding some sales data on current plugins. Feels a bit scary to spend like 3 months on something with a very vague view of how much things sell.
Is 100 x numberofreviews a reasonable metric? Presuming no cheating by the devs that is.

A lot of people do not leave reviews, not only that the reviews aren't really reviews for the most part.
Some plugins sell very very well, others.. not so much.

The better people know you, the more people will see your stuff when you post it.
