If we were to create an extensive amount of edits to an image (such as do a bunch of compositing, re-drawing large areas by hand, colour correction or animation) where do the rights go as an artist? Do we own the edit and can do what we want as long as we credit DALLE as assistance to the final result?

This is something I have been asking myself as well. I should have used the GPT-3 pricing as reference in the survey earlier this week as my idea of pricing was A LOT higher than the rest of the community. I certainly overestimated the processing costs, costs for maintaining servers, etc.
I did note that the higher the pricing is, the more I would use this in mainly a professional setting instead of personal. I believe there is an equilibrium that will make it worthwhile for both personal and professional use, I just don't have enough information to make a sound decision on where that could fall.

I totally get you, conspiracy is a favourite genre of mine and I love your idea, but fake news is a big dark side of DALL-E that’s yet to be explored.

People in this server will not believe the flat is Earth 😁 Of course. But such wild conspiracies have been a great weapon in politics to keep the uneducated and parts of the general public occupied with all sorts of bullshit (like the flat Earth conspiracy) but rather pay attention to what’s really going on.

This is a very, very complicated topic and as I said it’s complications are yet to be explored. Fake news is what won Brexit and Trump, but I will refrain myself from discussing politics.

I hope I answered your question on why some topics and keywords are banned 🤟

long lily

And to add to what I said, the OpenAI team said that with time the guidelines will change and loosen up, artists will have more freedom.

Their goal is perhaps to build an algorithm that keeps track of user behaviour and what they create as part of an effort to fight against fake news.

I think human art should be limitless and up to our imagination, but with great power comes great responsibility. We cannot just let people create photorealistic NSFW photos of celebrities or public figures.

Imagine you generate a fake photo of a politician doing drugs or partaking in illegal activities, send it to a yellow press gossip journal? That’s just the tip of the iceberg, honestly.

Hi guys! I have a question about how the copyright exactly works? During webinar, I remember Natalie saying that you could use, even sell, the images if you for example create a poster or print it on t-shirt. I am more curious about cover for the book.
But in Terms of Policy it says that it can be used only for non-commercial purposes. Which seems opposite to what Natalie said. I remember it was said during webinar that the image itself, like.. that file itself, is what cant be sold or used and "belongs" to Dall-E. But if you change it however, it no longer falls under her copy-right and you can use it even commercially, but you always have to credit Dall-E and mentioned what she did.

So in short, I ask if you can use the art Dall-E creates for book's cover purposes for the book that will be, well, sold. With giving proper credit to Dall-E in the book that the illustration comes from her.
And if this could be used for a book, is there some terms of policy where is commercial use mentioned?

Hope this makes sense.

Thanks!

I came here for posters and I made sure to SPAM abbout it in chat during the onboarding meeting. Whether it was my question she read or somebody else, she touched on the subject multiple times.

Take all I say with a grain of salt 101%, but she touched on heavily that what is off the table are NFTs and more specifically selling the file that you download from OpenAI. Literally the file you get.

When asked about posters and tees, she said that is okay.
Now, in Discord, some say commercial use is off the table.
I remember Joanne saying that all of this is complicated due to the 1001 factors that have a role in writing a Copyrights policy that will work now and in the future.

AI is a new thing. It may be very exciting, but what we need the most is for people to think of the bigger picture and that's what the nerds at OpenAI are doing (apart from getting blazed & tan on vacation 😛 as they should 💅 )

Super grateful to use DALL-E, nevertheless the restrictions, hold on policies and anything else. It's a blessing!

I just got a content policy warning for the following prompt; can anyone tell me why?
"Rococo painting of an anteater dressed like Marie Antoinette, surrounded by cherubs, style of Jean-Honoré Fragonard, style of François Boucher, style of Jacques Philippe Caresme".
I have been testing what happens when you try to refine an art style by listing some exemplar artists of the period. This is the first time it has failed to adjust somewhat appropriately. I took a chance and tried a simpler prompt omitting "cherubs" and only listing one artist and it also threw a content warning: "Rococo painting of an anteater dressed like Marie Antoinette, style of Jacques Philippe Caresme". Jacques Philippe Caresme died in 1796, so he can't sue me. These prompts were attempts at variations on a prompt by another user which produced good results: “Rococo painting of an anteater dressed like Marie Antoinette”.

# wheat zodiac I came here for posters and I made sure to SPAM abbout it in chat during the onb...

They indeed deserve the vacation!

I remember also what Joanne said, they just stuck on what was the most simplest thing to do (policy-wise) and that results to the policy of using DALL•E for non-commercial purposes only.

Numerous people have already mentioned Natalie's stance on that. I'm not planning to use this for any commercial purposes for now, but for those who do, I'd wait for it to be in writing. Either in the Policy or in the Terms. 😁

# potent lichen Hi guys! I have a question about how the copyright exactly works? During webinar...

@potent lichen and @wheat zodiac thanks I am also interested in DALL-E copyright questions!

I was also wondering about how OpenAI navigates the copyright of images in DALL-E’s dataset. I think it’s fine to be able to generate images in the style of an artist who is no longer living. But if an artist is still alive I feel it’s unfair to them if DALL-E can cop their style already. I’m thinking of artists who have a very iconic, recognizable style like James Jean for example.

I know DALL-E can already do stuff with popular characters like Darth Vader, Homer Simpson, etc. Just that ethically, taking from big corporate-owned IP feels different from taking from an independent artist.

verbal crag

potent lichen
# wheat zodiac I came here for posters and I made sure to SPAM abbout it in chat during the onb...

I asked about copyright policy during webinar and Natalie read that question and that's the answer she's given, what you are saying. That NFTs are forbidden, as well as selling the file you get from Dall-E, but using it for posters or shirts or if you edit the picture in any way, then it belongs to you and you can sell it (but have to credit Dall-E properly).
So this sounds like book covers (and someone here wanted also in-book illustrations) should be okay. But if you go only with Policy content, it seems like it is a no-go.
But also as you mention, she was mentioning that they are still writing more advanced copyright policy, but it takes time since it is such a robust subject (obviously). So maybe they have something written about allowance of book covers and stuff, but it isnt on the page officially yet.. (?)

the thing is, "dall-e artist"s will become a thing and you can literally "draw with words". Some things people can already do when they know what to say is crazy. And at this point Dall-E cover can look as good as commissioned art. Often times better, miles better (at least compared to many of books from our local authors).
"put some effort into it and commission an artist".. isnt this effort too, tho? spending countless prompts and coming up with the perfect prompt that will produce the image you'd want?
This all sounds kinda like a pre-Dall-e talk to me, tbh. But, imo, "dall-e artists" is an inevitable outcome.

I have a question regarding the license: can I use DALLE-generated images as a reference that architects will use for making digital locations? In a commercial project.

Technically I can and no one will ever know that there were AI-generated references lol, but I think it's cool if I can publically say DALLE was used there.

# tight pine i honestly dont believe that you are allowed to sell the artwork once you edited...

they said if you edit it even a little bit, it is yours.
you can use it for textures for games/movies etc.
I'm checking my notes during the call and I see there was a mention of using it for books allowed.
One thing they cant do now is give you ownership of the Dall-E file. You can even sell the Dall-E art in a gallery, when printed on canvas or whatever. Thats clearly a commercial use.
Seems so far, that the "commercial use" is only about the file itself. Not the image as it is. If that makes sense.

Yeah no, this is just flat out wrong.

https://www.reddit.com/r/Fantasy/comments/vp2ose/self_published_fantasy_releases_july_2022 Take a look at some of the recently self published fantasy novels and youll see that for many of them their covers are very well made. as someone who has been using Dall E 2 for a while now to try and create good characters it is very much not there yet.

"put some effort into it and commission an artist".. isnt this effort too, tho?
a lot less effort than getting a professional to do it with worse results.
you as the author can do whatever you want but as a longtime member of the fantasy community i can assure you that Dall-Es book covers cannot yet compete with professionally made book covers.
But, imo, "dall-e artists" is an inevitable outcome.
i wouldnt say. for all we know this could be the limit of what the technology is capable of. or its just the beginning. who knows. i wouldnt say with certainty that dall e artists will become a thing or more importantly be able to substitute professional artists.

yeah, well, that's those books. What if I want it to use for a philosophical book or something like that? Real cover for that can be real awful. Just take a look at the cover of "Brave New World" from our country. I still havent bought it cause I hate this cover so much, lmao..

"a lot less effort than getting a professional to do it with worse results.

depending on a budget you have. the commissioned work could look cheap as well.
well, for some reason you are focusing solely on fantasy book cover and nothing else. Ive tried some philosophical cover styles and it looks very interesting.. Ill post the pic below. And it is much better than whatever that Brave New World cover we have is.

"i wouldnt say. for all we know this could be the limit of what the technology is capable of. or its just the beginning. who knows. i wouldnt say with certainty that dall e artists will become a thing or more importantly be able to substitute professional artists."
it seems inevitable at this point. the technology is still improving and will get even better. Ive already seen "dall-e photographer" with some insane result. Yes, with PS being used to finish some stuff up, but Dalle isnt always supposed to be a one way stop. But a software in your creative process. (im gonna try to find the pic he did)

@tight pine here's the "book cover" example.
dont be focused on a pure fantasy book covers and seeing dall-e as incapable of doing book covers. that's just a limitation of seeing on what the book covers could be used. books have more than just "fantasy covers"

# wheat zodiac Do you guys make money with NFTs? I get the hype, but I always thought its rich ...

I’m still on the fence about NFTs. I think blockchain tech is promising but the vibe around crypto in general right now just feels so scammy 🤣

I feel much more excited about AI tho I’m also nervous it’ll take my job as an artist someday haha. But I enjoy using it and it means a lot to me that OpenAI team takes AI risk mitigation seriously. I know this is powerful tech and I want it to be wielded responsibly

#

Sorry, just noticed this is the wrong channel for this 😅

elder cradle
#

I don't see any problems with NFT, I mean, if there's people buying it, that's their problem.
You can't really think that every single person creating NFTs will suddently go rich. Money comes from somewhere, you can't really make everyone rich, so it's a gamble, just like we see tons of really creative people making incredible stuff that never get the attention they deserved.

#

Money laundry with NTFs sound far fetch, crypto transactions has fees and there's always the possibility of devaluing, I don't think mobs would be buying some dumb monkey drawings for this.

#

I know artists that create impressive paintings and can barely live with that, if people with money are interesting of owning a digital file these days, so be it.

#

I would recommend artists to also join the NFT train if they want to bring more attention to their art.

#

The thing that people love about art is not randomness, it's consistency, and no AI can consistently make a style of anything. You may ask for a painting of a black cat and get cartoonish results, a orange cat and get realistic results.

#

Sure Dall-E can create stuff that looks nice, but doesn't mean that it alone make you an artist

#

I guess creating good prompts can become a kind of art by itself, but you can't beat an artist with their own distinct characteristics.

#

Even In-Painting is not perfect

#

Got this, wanted the left cat to be fully black

It got smaller in the process and lost the expression that made me like the drawing

Summarize this for a second-grade student:

A high-level overview of unCLIP. Above the dotted line, we depict the CLIP training process, through which we learn a joint representation space for text and images. Below the dotted line, we depict our text-to-image generation process: a CLIP text embedding is first fed to an autoregressive or diffusion prior to produce an image embedding, and then this embedding is used to condition a diffusion decoder which produces a final image. Note that the CLIP model is frozen during training of the prior and decoder.

UnCLIP is a model that is trained to learn a joint representation space for text and images. This means that when given a text description, the model should be able to generate an image that corresponds to that text. The model is made up of two parts: a CLIP text embedding, which is a text representation that is fed into an autoregressive or diffusion prior, and a diffusion decoder, which is an image representation that is used to produce a final image.

#

is the generated image Dall-e's imagination?

past geyser
#

It's not really imagination as you or I have it. It's more like trial and error: it's trained to connect language to images, and using massive graphical processing power it works with a baseline of regressed noise to generate something like what the words provided should look like. I'm no AI expert though so hopefully someone can correct me / explain better.

I know that the last answer was that it will depend a lot on my use for the image, however, for now we have no commercial use for any of the images, just using them for variations or making edits to portions of the images, and who gets to use the actual uploaded images on training and stuff is Openai, so this is more on their side.

@neat bridge I know you’ve declared discord bankruptcy so just wanted to flag this in case you missed them, there are some questions in the back scroll around what are the commercial usage rights on dalle generations. In particular, people seem to have gotten different advice (using the digital file “as is” as a (say) nft is obviously bad, printing the digital file “as is” on paper or a tshirt some people were told is fine). Some clarification around that would be nice when you have a second! ❤️

@neat bridge I have a bit of a fringe question, but I was wondering - Will there ever be a time that "generations made but not saved to you collection" will be wiped? I started saving a bunch of my generations to bookmarks so I could retrieve them when I had hit the previous 1000 limit in my collection. I hope I asked my question in the right way...

neat bridge
sullen sierra
#

Sure, well, I hit my 1000 limit is the practical reason I started, and now it's more of a reflex to bookmark the generation page. And I do save "my favourites" by downloading them sometimes, but only my "absolute favorites" or ones I think will be useful as reference in my active projects, or ones I want to share with friends or online.

But the utility of saving them "in dalle" is actually for ease of "using them later for edit/variations" rather than re-uploading them. I also generate so many, often hitting my daily limit, that dalle just kind of keeps them much more organised that I do in a big folder. Maybe I could be better at self organisation, to be fair.

sullen sierra
neat bridge
#

@sullen sierra (and others feel free to chime in!) can you tell me more about how you navigate your giant collection and why? are you often searching for a very specific image with a caption in mind? or is it to browse + admire?

velvet pendant
#

I like how the collection looks with all my best works together, I think it'd be cool if there were like custom scrapbooks we could fill with groups of our images together. also feel like the 3 wide collection can be slow to scroll down to find stuff

sullen sierra
# neat bridge > But the utility of saving them "in dalle" is actually for ease of "using them ...

I have found what I call "sweet spots" where Dalle generates things that just inspire me. Endlessly. For example, Lord of the Rings locations, or "Fantasy Cities" or "Space Ships" or visualising images from my personal writing. So, my giant collection is compartmentalised in my mind into "work and play" and subgroups - practically, I save images because I can see them informing/inspiring a piece of writing, or a piece of art I want to make, or they're just plain reference.

Or, following advice from my art teacher in high school "never screw up a piece of paper and throw it away if you don't like the drawing, you never know how you'll see it again tomorrow" and I feel the same with Dalle. I often go in with an idea, or a goal of what I want Dalle to show me, and often I get that, but then also five incredible other images... So... I like to save them so I can look at them another day when I'm not looking for something specific and see what that sparks, or what that inspires.

At the moment, I navigate by key word, or by artist, or by whatever the "Sweet Spot" is (Fantasy City, Cats with Hats [thats not one but it could be, you understand haha]) I tend to accrue "collections" almost exclusively and there are often very few "one offs" for me. I guess practically I "save" an image to my Dalle collection if I would be mortified to ever lose that image and forget some nuance, or some idea that it gave me when I first looked at it, it's really quite personal. I do the same with real-life things, books, art books, music, images, too, really.

neat bridge
#

super interesting, thank you both!

@sullen sierra if every single image you've ever generated were saved by default, how would that affect what you save?

sullen sierra
# neat bridge super interesting, thank you both! <@575543894939402240> if every single image ...

I would save
"ones that blow my mind right out of my skull and into the stratosphere" and
"ones that I will definitely refer to in my art or writing or work in some way" and
"ones I really have to show my friends/partner" and
"ones to share on the internet because they're cool and would make a great collection" and
"if i lost this image I would never forgive myself because it's too special and the future generations must know of this" and... I think that's it.

neat bridge
sullen sierra
# neat bridge do you currently use bookmark folders to keep track of those separately?

I dont, I save them in a "dalle" bookmark folder and either name the bookmark the entire prompt I used, or, for ones that align more with my above criteria will name the bookmarked page single words "spaceship" "rivendell" "landscapes" "mountains" etc -

I have a lot of methodology to my dalle use so if I'm looking for something I can find it by mentioning an artist I used since "they do this sort of thing really well" or a style "art deco"

#

It's a bit like my own personal google search, when I search the dalle folder for "art deco" i get all my never before seen art deco attempts. they're not individualised per image, just per six generation pages, by the way. I save the six generations, not individual images to my bookmarks folder.

neat bridge
#

in case it's not obvious why i'm asking, i've been thinking a lot about image organization / showcase features.

we've had pinterest-style multiple collections in mind for a while, but i've learned that a lot of users have been using collections more so to not lose any image they find remotely interesting (vs. saving images they love). and if the former is a bigger problem than the latter, we should probably prioritize saving every image by default and build some sort of search capability; if curating + grouping favorite images is the bigger need, we'd prioritize multiple collections.

what's a bigger problem for you?

velvet pendant
# neat bridge in case it's not obvious why i'm asking, i've been thinking a lot about image or...

I do find myself saving images that I wouldn't consider "share-worthy" but interesting, so I think that is the bigger problem, but I'd also like curating features, although that can probably be done after as you can just sort all the images you've already saved. For me I think the ideal layout would be a tab with all past images generated, a main collection tab with saved images, and subcollections for images you want to put together. I'd also like to be able to give links to subcollections to people so I don't have to send a bunch of screenshots, and public/private options. Also options to better display a collection than just a 3 wide column, maybe like a scrapbook with pages. Also I think a search feature would probably be higher up on my wants than most of that - I'm at around 100 saved generations and scrolling is kinda slow for me, so a search would be great. Not trying to be too demanding, just giving my thoughts 😅

sullen sierra
# neat bridge in case it's not obvious why i'm asking, i've been thinking a lot about image or...

I think that's bang on: a search function would be fantastic. Then there wouldn't really need to be anything higher than a "personal collection" for whatever reason that people want to save images. I think dalle is so fascinating that everything feels novel, so there is a lot of saving going on. I mean, I think that is a great special thing though, dalle is likely not going to get 'less novel' in its results, we'll just get more used to it being incredible...

Anyway, I think it also matters if you are interested in fostering some kind of "Pintrest" type of platform. Do you want people to curate outward facing collections? like a profile page? If so, then make personal collections public and "re-organisable" and let people save other peoples work to a "community saves" and that's that. Have them all be searchable by keywords that people used...

A search function paired with "everything youve ever generated is saved" paired with "every image that has ever been generated by dalle searchble by used keyword" would be pretty neat!

Very tangentially I often wonder if you could expose the, probably incredibly large "verb cloud" that resulted in dalles generation. So... I asked for "A cat on a boat that looks like van gogh in a fantasy city make of cucumbers" but I sometimes wonder "what are the other words here that dalle drew from to give me this image?" - i think this is a pretty tangential and irrelevant question tbh... I just wonder sometimes when I get something that is nothing like what I asked for, or, I get something that I want to understand "why is this element so much /better/ that the other five" I want to know what part of my prompt did dalle draw from to get "those specific towers" or "that level of fidelity" .... probably impossible though.

craggy haven

I do more or less the same. I bookmark every one of my generation pages to a designated bookmarks folder. Good or bad, even just other's requests, they are all added to the folder. I'm considering writing a simple extension that would bookmark my generations automatically instead of me having to do it manually all the time. (It becomes a chore after a while).

I bookmark them because I don't want to lose them, it's organized (unlike browser history), and I can keep track of everything I make. I can also publish old generations if I chose to.

I'd be in support of expanding Dall-E's "history" functionality beyond just the sidebar of recent results. I think a method of accessing all your previous generations in-app without externally keeping track of urls would be appreciated by lots of users. The expansion of the history sidebar from 10 to 50 was already really great to see. Of course OpenAI can't host all of our images forever, so perhaps a sort of "expiry date" could be introduced. e.g. Users are told that their results will be wiped after x months.
