When using on_behalf_of the connected account is the settlement merchant. So the Charges are settled in the connected account’s country and settlement currency. Without on_behalf_of the Charges are settled in the platform account’s country and settlement currency.

Does that make them the merchant of record?

The charge remains a destination charge, so the Platform will be always responsible for refund for example.

It depends what you mean exactly by "Merchant of Record", when using on_behalf_of the charge currency is the currency and country of the the Connected Account otherwise the Platform. For refunds, the Platform account is the responsible for all cases.
