Hereā€™s my two cents on Moore vs Harper though, like after considering everything. Regardless of whether or not the legislature was in the right to defer to the federal government to settle the matter, at the end of the day I do think that the federal government is the one that needs to shoulder the responsibility of settling the matter. Thatā€™s, in a way, itā€™s purpose. However, I agree with you that this sets a dangerous precedent, because it does weaken the stateā€™s constitution and judicial branch at the expense of the state legislature and the federal government. State legislatures in the future might be able to use this case to expand their power, while the federal government might use it to intervene in states in the name of settling conflict between branches. In the United States, we have seen Imperial Presidencies with respect to foreign policy countless times, but not usually with respect to domestic policy. The aftermath of this case could pave the path to a far too dominant federal government, and even an Imperial Presidency one day, with respect to domestic policy.
