When you include a mod from outside of Modrinth, we aren't able to automatically download that mod in the app via it's Modrinth link since... it doesn't exist.
Instead, the project is included as is in your modpack file, this means you're directly distributing it, and we call this an "override".
Projects in your overrides are subject to the licensing and will of their authors, so you'll need to make sure you have permission before uploading your modpack to Modrinth.

How can I determine if a given mod/project can be used in my modpack?
Ok so.. If I understood correctly when I create my first modpack there will be some files that are mandatory and since those mods are not in the modrinth library they will be included in these mandatory files for the modpack when downloading. Is that it?
Do I still need permission if the mod is publicly and freely available?
Depends on your definition of "public and free", but just because a mod can be downloaded, does not mean you have permission to redistribute.
