BREAKING: Former US President Donald Trump has been fined $10,000 for violating a gag order in his civil fraud trial. Justice Arthur Engoron imposed the fine after Trump briefly took the witness stand to take questions about the order https://reut.rs/3Q5lkmO
He's really just going to keep stacking fines I guess
And as we all know: when the consequence is monetary, it's only a crime for the poor
Need help keeping Trump's problems straight? So does everyone else:

Chutkan issued the order earlier this month after prosecutors raised concerns that the former president could intimidate witnesses or encourage harm against prosecutors through his public comments.
Trump now faces two gag orders barring him from discussing aspects of his legal cases in the public: One from Chutkan, who is overseeing the case brought by Smith in Washington, DC, and a second from the judge overseeing his civil fraud trial in New York.
no more threatening then? Yesterday it was a last stern warning
Will there be a live coverage?

Damn

Seems a nice one, although I lose a little respect for the judge for allowing the apparent speeching and rhetoric after warning.
Apparently Trump is trying for a mistrial.
But I can't get to the file. Anyone in the US perhaps?
was wondering about that one. Last time he said something like this some nut went and did it

“I have already testified to everything & have nothing more to say other than this is a complete & total election interference (Biden campaign!) witch hunt,” so “I will not be testifying on Monday,” Trump said in an all-caps, two-part post on his social media platform, Truth Social.
Jonathan Daniel Pollock, Olivia Michele Pollock and Joseph Daniel Hutchinson III were taken into custody early Saturday morning, according to a press release from the FBI. They are scheduled to appear in federal court in Ocala, Florida, on Monday.

“Not having heard from you by the third extended deadline (noon today), I assume that Mr. Trump will not agree to the reasonable, lawful limits I have imposed as a precondition to giving a closing statement above and beyond those given by his attorneys, and that, therefore, he will not be speaking in court tomorrow,” Engoron wrote.

He's asked to withdraw along with the other two members of his firm.

If the challenge is successful, the Supreme Court could potentially wipe away two of the four counts that special counsel Jack Smith has brought against the former president in his federal election interference case
More odd power dynamics at play with long-term consequences.
More issues on the horizon?
“If I had been vice-president, I would have told the states, like Pennsylvania, Georgia, and so many others, that we needed to have multiple slates of electors, and I think the US Congress should have fought over it from there,” he added. “That is the legitimate way to deal with an election that a lot of folks, including me, think had a lot of problems in 2020.”

"Neither the Special Counsel’s publicly filed Response nor the accompanying sealed filing identifies the information it seeks to redact," Cannon wrote in her order. "Although 'protection of a continuing law enforcement investigation' can constitute a compelling governmental interest ... the Special Counsel fails to identify the information at issue, provide any explanation about the nature of the investigation, or explain how disclosure of the code name would prejudice or jeopardize the integrity of the separate investigation (assuming it remains ongoing)."
Cannon is absolutely going to be removed, if not for procedural incompetence alone yet for the natsec implications.
Yea she's definitely pushing boundaries. I think she's running to (self-)destruction.

just in case
Perfect. I was going to ask about the security bit.
It is a lot of cash. 💰
I’m doubling checking the PAC/Donor money he’s spent on lawyers now as a % of his total fundraising.
It’s a lot as well. I’ve seen the claim 25% of his total fundraising, but want to verify looking at the actual FEC data.
Prejudgement interest too. Appeal bond 120% oh man the math is getting very mathy.

He will rule on merits after full briefing, to be concluded on 3/2. 3/11 is end date to pay up in the Carroll case.
Judge Kaplan noted the "tardiness" (my wording) of the submission and the fact that it was filed right before plaintiff's lawyers file liens.
In rejecting the motion, the court noted that Trump waited 25 days after the judgment was filed to make his request right before the deadline for Carroll's lawyers to begin attaching liens on his assets. The court also noted that he hasn't even filed any post trial motions yet, only a request to delay the collection of the judgment. Judge Kaplan rejected the request and ordered that briefs be submitted next week.

The text messages raise questions about Bradley’s credibility, and the degree to which Merchant appeared to rely on his claims that she was then unable to substantiate elsewhere. While a panel of the U.S. Court of Appeals for the D.C. Circuit upheld Larry Brock's conviction, the court said a judge wrongly applied an enhancement that lengthened the recommended prison sentence range under federal guidelines.
The enhancement — on the grounds that Brock's conduct resulted in “substantial interference with the administration of justice" — has been applied in more than 100 other Jan. 6 defendants' cases, said Patricia Hartman, a spokesperson for the Washington's U.S. attorney's office. If the ruling stands, those defendants who have not already completed their prison terms may push for new sentences.

To summarize Trump owes/still owes $466,000,000+ interest for NY Civil Trial he lost because he and his entire family committed massive real estate fraud, $400,000 in legal fees to the NYTimes when he sued them and lost (the tax records story), $382,000 in fees and fines for Orbis Case (Christopher Steele) he lost and back to E. Jean Carroll he still hasnt paid the $5,000,000 for SA case for and defaming her that he was found guilty and lost and this $91,600,000 Bond. Total: $563,382,000 + interest.
Again, he’s broke and highly leveraged. https://www.forbes.com/sites/kylemullins/2024/03/02/heres-how-much-cash-donald-trump-has/?sh=3b700a6985f5 with non-paywalled archive https://archive.ph/Ccbs9
I'm sure it's a formality indeed. I don't really know Chubb or enough about the us system. Chubb to me is an alarm company, not a bank :)
Yeah, Chubb is an insurance company based out of Zurich but it has divisions and subsidiaries in lots of areas and locatioms. It’s traded publicly but has had a huge amount of controversy around the business for lots of shady things. Greenberg stated that this would be the only bond they would secure for Trump.
He might get some cash from the Truth Social SPAC deal going public https://www.vanityfair.com/news/donald-trump-truth-social-media-merger which again is shady, just another way to launder money to him personally. 200,000 +/- DAU and probably a lot lower https://amp.theguardian.com/us-news/2022/apr/09/truth-social-trump-app-failed-products
Really questionable how much cash he could get from $DWAC/TruthSocial, he’s got a lock up period, and bulk sales will tank the price. Then again it could be a vehicle for wealthy people who want his policies to buy in and launder the money to him (similar to his shady real estate deals). It’s an area to watch and has osint angle because it will be public.
this, as with all Trump dealings, is shady and fraught with legal difficulties:
While Trump is facing a growing legal bill, he cannot immediately cash out of his shares, if and when the deal closes. Securities laws would prevent him from selling massive amounts of stock all at once, and the deal’s terms tie up his stake for six months — unless Digital World elects to waive the so-called lockup provision. Trump could, however, still transfer the stock into a trust.
good catch on your part imo.
Yep 💯 %
I’m reading the prospectives now, read them a year or so ago when they claimed they were going public merger then. It’s full of nonsense and shadiness.

While allowing Trump to temporarily operate his business and apply for bank loans, the court ruled he must still pay the fine.

Noting the bond at campaign rally in Rome, Georgia, Trump once again called Carroll a liar:
I just posted a $91 million bond, $91 million on a fake story, totally made-up story. $91 million based on false accusations made about me by a woman that I knew nothing about, didn’t know, never heard of, I know nothing about her. She wrote a book, she said things. And when I denied it, I said, “It’s so crazy. It’s false.” I get sued for defamation. That’s where it starts.
I wonder if he's breaking some kind of record.

I think Andrew is a little off the mark with that post. Trump still needs $471,782,000+ interest in a matter of days. Chubb is out as a carrier of the bond of which he''s late on the $5,000,000+ he still owes E. Jean Carroll. Appeal is going to be entertaining and likely shutdown quickly given his public statements, which will be used against him. A lot of pundits keep mixing up the cases the the sum totals. On Monday, Carroll's lawyer wrote in a letter ... that they don't oppose Trump's proposed $91.6 million bond but that it is subject to a small change to one of the terms.
The change reduces the amount of time between the resolution of Trump's appeal and Carroll's payment from an overall 60 days to 30 days.
"As a result of those discussions, Federal Insurance Company has authorized and Defendant's counsel will agree to stipulate that the 30-day periods listed on page 3 of ECF Doc. 318-1 will be shortened to 15 days, both for the Principal and the Surety. This will have the effect of shortening the overall window to 30 days."

Evan forgot to mention Donald J Trump and Evan's father are close personal friends and that Evan worked for him when he was in office.
Follow up questions by journalists should be how many surety bonds does Chubb issue annually and to whom.
I wonder if the people backing this bond are the same ones that backed Trump's loans from Deutsche Bank?
This is all Chubb and Evan. Deutsche Bank was all Rosemary Vrablic and crew.
I think Deutsche Bank had its own backers a little further east. This is why I compare Chubb to them.
Trump’s attorneys said he has approached 30 underwriters to back the bond, which is due by the end of this month.
“The amount of the judgment, with interest, exceeds $464 million, and very few bonding companies will consider a bond of anything approaching that magnitude,” Trump’s lawyers wrote. (Trump himself was fined $454 million; the $464 million includes the disgorgement for his adult sons Don Jr. and Eric.)

Even a surface reading of it I can see they screwed up the redacting, in the subject of some of the txt message files they redact some names but then in the message the first name of one of the redacted subjects if used in the clear.
If one were to accidentally leak something, shoddy workmanship provides plausible deniability.
Also a lot of these pages are just giant replay/forwards too. kind of mind numbing, which is what the foia officers always do. just enough to drive one batty. the ultimatum itself makes no sense, if it's accurately depicted as:
allow jurors to see a huge trove of national secrets or let him go.
The first option would require Smith to allow any of the randomly called potential jurors ... to suddenly have access to what prosecutors have described as extremely alarming national secrets.
The second option would essentially force jurors to acquit the former president of wrongdoing, given that they’d be told he had unquestionable authority to assert personal ownership over any government document within his reach—a self-justifying rule outside of anyone’s review.
blatant false choices, so yet another clumsy delay tactic because obviously that will get contested.

So this judgement filing indicates NY AG James is going after *Seven Springs *(41.16624178644961, -73.69555778339625) (which is actually a beautiful historic property Trump kind of abandoned to rot, once built and owned by the former owner of the WaPo and head of the Federal Reserve), *Trump National Westchester *(41.146117434375654, -73.83329216857285) and Trump National Hudson Valley (41.571933962278116, -73.76093507821847). *Seven Springs *is actually quite potentially valuable but Trump tried to trick locals into funding his conversion of the properties into a bunch of ugly mega mansions, it's quite close to the towns of Katonah and Bedford which is a horse country hideaway for some Old Money American wealth and also, celebrities and also people like the Ralph Lauren family
.
Yep, NY State. He hasn't met his appeal bond, so the property goes to the state after seizure until the appeal works it's way through state courts.
A bigger and really damaging turn is that the court ordered minder of his companies has now been ordered by the judge to get involved in every detail of day to day operations.
He's got four days left to post bond. Which he won't, because he's broke, and always has been.

Truth Social's parent company could complete its merger with a SPAC as soon as Friday.
Former President Donald Trump could reap billions from his social-media platform just as he struggles to find the cash needed to persuade a company to pay for a $456 million appeal bond for a New York state civil fraud verdict.
On Friday, shareholders are scheduled to vote on a long-delayed merger to bring Truth Social's parent company public. Trump's stake, according to The Wall Street Journal, would be worth roughly $3.5 billion.

For sure, stock sale is locked up, would have to get waiver to sell. Any sale in volume will tank the price. Buyers are going to be hyper scrutinized by three letter agencies.

Investors have approved a deal on Friday to make Truth Social owner Trump Media a publicly traded company. ... Trump's not allowed to sell or borrow against any of his shares for six months, but that could change if a board consisting of his allies and family members agrees on it.
Fortunately for Trump, the board consists of close allies like his son Donald Trump Jr.; former Rep. Devin Nunes; Linda McMahon, a major Republican fundraiser who served as Trump's Small Business Administration head during his time in the White House; and Kash Patel, a former member of Trump's National Security Council who published a children's book about 'Hillary Queenton' and 'handsome King Donald'.

https://www.huffpost.com/entry/nick-akerman-trump-million_n_65fc5353e4b0d2a3e7778a54
Trump’s team claimed in a court filing this week that “obtaining an appeal bond for $464 million is a practical impossibility under the circumstances presented.” (That figure includes $454 million for Trump himself and millions more to cover the disgorgement for his sons.) The brief said that he had been rejected by 30 bond companies, which would only accept cash or cash equivalents as collateral.
Nick Akerman, a legal analyst and former Watergate prosecutor, appeared Friday morning on CNN to discuss the developments.
“That is the dumbest thing he could have possibly done, to put that on Truth Social, because that is a direct admission by him that he has the money,” Akerman said, in a clip flagged by Mediaite.
“Keep in mind, even with this operating money or cash that he supposedly has, if he doesn’t pony up and put up a bond, Letitia James is going to be able to go in and basically put restraining orders on all of his bank accounts,” he continued.
“Everything that relates to him and all of that money is going to be tied up and frozen. So if he’s really got that money, he’s got to put it up.”
Monday is the deadline ⏰

oof.'
The property auctions would be fun too. Once they are seized they go up for public auction to satisfy the judgement. Then they go under the auction hammer. 🔨
that may end up working in his favor, if wealthy sympathizers collude to create non-compete bids at the opening bid and then return said stock to previous owner.
(this happened when Willie Nelson's assets went up for auction due to IRS action.)
Bankruptcy helps but again, optics of that politically are hilarious and hazardous. It also opens him up to even more scrutiny financially.
that recently backfired against Alex Jones.
Yep, a possibility too. Also pits a lot of heat on the buyers. NY AG james could scrutinize every dollar to make sure it’s not on/from OFAC listed entity or person.
Lawyers were puzzled by the Mar-a-Lago trial judge’s order on Monday, asking the prosecution and defense to propose jury instructions assuming the Presidential Records Act (PRA) allowed former President Donald Trump to unilaterally deem classified documents as personal. The response to Judge Aileen Cannon’s order was quick and clear, with some noting an increased chance of acquittal.
Smith pointed out that according to the provisions of EO 13526 outlined in the Superseding Indictment, once Trump left office, he lacked authorization to possess classified information, never received a waiver permitting him, as a former President, to possess such information, and stored documents in an unauthorized location for handling classified documents.

What changed? Mueller took down several key figures in the mafia from Boston to NYC (Gotti the first "Teflon Don," Gravano, et al). This left a black market power vacuum. Did they cite a legal precedent for the reduced judgment?
Trump has a long, demonstrable history of not paying. Surely they are aware.
Nope, no precedent cited. It is ordered that the motion is granted to the extent of staying enforcement of those portions of the Judgment (1) ordering disgorgement to the Attorney General of $464,576,230.62, conditioned on defendants-appellants posting, within ten (10) days of the date of this order, an undertaking in the amount of $175 million dollars; (2) permanently barring defendants Weisselberg and McConney from serving in the financial control function of any New York corporation or similar business entity; (3) barring defendants Donald J. Trump, Weisselberg and McConney from serving as an officer or director of any New York corporation for three years; (4) barring defendant Donald J. Trump and the corporate defendants from applying for loans from New York financial institutions for three years; and (5) barring defendants Donald Trump, Jr. and Eric Trump from serving as an officer or director of any New York corporation in New York for two years. The aforesaid stay is conditioned on defendants-appellants perfecting the appeals for the September 2024 Term of this Court. The motion is otherwise denied, including to the extent it seeks a stay of enforcement of portions of the judgment (1) extending and enhancing the role of the Monitor and (2) directing the installation of an Independent Director of Compliance.is the entirety of the stay.
it enforces the rest of the judgements in the original ruling as well.
April 4, 2024 by my calendar. Trumps attorney's earlier insisted the rest of the judgement had to be stayed in order for him to post bond, but the Intermediate Appeals court locked that down with this ruling. Also, he still has to get through the full appeals process. Which if he skives off on this part, is not a great look in the eyes of appeals Justices as the review the entire case.

Stating that he is not giving investment advice, Hiltzik wrote that Truth Social's reported valuation of approximately $5 billion does not match up with its cash flow after three years.
After writing, "It should be noted that SPACs in general don’t have the best reputation in the corridors of the SEC, because they could be used to execute initial public offerings without making the customary pre-IPO disclosures to investors," he added, "It should be plain that the valuation has no rational relationship with Truth Social’s financial picture, which is ugly in the extreme."
ugly in the extreme
he says, executing exacting (though fitting) hyperbole.
fwiw Bonds are reduced all the time. Robert Durst murdered three people and had his bond reduced. Plenty of others fall in this category. The thing is, he's been whinging about it non-stop which hurts him legally in this case (which his posts among everything else should also be disqualifying for any Presidential candidate) (a lesson for us all "do not post"
)
He claimed in his Truth Social post he would abide by the lowered amount, which again hurts in his appeal if he doesn't follow through. So it's just more fodder for the judicial fire if, no when, he fails again. He's broke. No one wants to give him the money. His assets are a joke, he doesn't own 40 Wall Street, he has a ground lease on it. It's paper nonsense. He has to use his own cash for this.
I think a good way of thinking of this case is other cases, like Holmes and Theranos, Madoff, etc. In those cases they materially harmed people, even contributed to deaths, but what got them was the investor fraud. Basically rich people got pissed they lost money. Americans at the end of the day are money obsessed and mercantile. The rubicon not to cross is financial. As morally unsatisfying and sad as that is, it seems to hold true over and over again. I am sure their are exceptions to this line of thinking of course.
Remember between this and the E. Jean Carroll Bond he's $266,600,000 in the hole and counting (plus interest). He still owes her another $5,000,000 which he still hasn't paid and will be getting hammered on shortly. If his reported cash holdings are truly at the $300,000,000 to 400,000,000 +/- range, that's 67% to 90% +/- of his claimed liquid cash. https://www.cbsnews.com/news/trump-bond-deadline-payment-new-york-fraud-case/

I really don't like live tv in courtrooms because I think it changes public and the juries behavior and counsel and prosecutor play to the tv rather than the facts of the case. That said it would be great for it to be released at some date way after the trial, because the bad behavior by defense counsel on his multiple trials I think is going to be studied in law school for a long long time.
tbh even the way it plays out now, how they rush to the press podium after each court trial, reads like (a) tons of damage control, (b) reshaping the narrative of what actually happened, and (c) winning the court of public opinion.
yes, they are absolutely doing that. it didn't work out with Judge Engoron, he slapped them down a lot for doing it. Another angle, and I know this is a no politics place, is that Trump is running around begging for money like a clown but also getting rightfully dragged around the courts across the country and he is not campaigning doing retail politics so to speak.

Nevertheless Trump has filed again claiming the facts have changed because he is now the presumptive Republican nominee and Democrats ... will supposedly benefit from the Trump prosecutions. But none of that materially changes anything with respect to the erroneous argument that Merchan has a conflict, because as matter of law we don’t hold judges responsible for the outside activities of their grown children. I believe Trump clearly is up to something other than winning these motions, and that it is fair to conclude tainting the jury pool is part of it.

Among those who did make it past the initial round of questioning was a man who works for a software company. The prospective juror said he followed Trump on Twitter when he was president and had read two of his books, including "The Art of the Deal," which resulted in a big smile and nods from Trump. He said not discussing the case with his wife would be a challenge, but ultimately seemed to accept that not talking about the case is a condition of jury service.

Betsy Woodruff Swan is the author?
I see.
Swan started her career as a reporter and William F. Buckley Fellow at National Review.[4] Amid a wider staff exodus from National Review in 2014, Swan moved after two years to the Washington Examiner to become a political writer covering Capitol Hill and electoral politics.
Yeah, if you have time I’d recommend reading up about her husbands history too https://www.huffpost.com/entry/wikipedia-paid-editing-pr-facebook-nbc-axios_n_5c63321be4b03de942967225 and Politico is an Axel Springer SE outfit with the CEO, Mathias Döpfner, praying that Trump is re-elected. Politico is high on access journalism and PR pushes. Doesn’t mean everything is wrong written by them, just another data point. Mary B. McCord and Chris Geidner are good resources on analysis.

Trump then furthered his criticism of the judge on his Truth Social platform, writing in one post both that he “will likely not be allowed to attend” and that “the Judge, Juan Merchan, is preventing me from proudly attending my son’s Graduation.” He wrote in another post less than two hours later that he is “being prohibited from attending.” Judge hasn't made a ruling yet if this is the case
D. John Sauer argued before the nation's highest court that "there can be no presidency as we know it" if former presidents aren't granted broad immunity from criminal charges stemming from official conduct during their tenure, including ordering the assassination of rivals as official acts, "depending on the" circumstances.

yeah, this scotus thing is going to be very wild
Merchan also threatened incarceration if Trump willfully violates the gag order again, writing in his ruling, “THEREFORE, Defendant is hereby warned that the Court will not tolerate continued willful violations of its lawful orders and that if necessary and appropriate under the circumstances, it will impose an incarceratory punishment.”
The prosecution has called Hope Hicks to the witness stand.
Another slap on the wallet
Judge Juan M. Merchan has again held Trump in contempt of court and fined him another $1,000 for violating the gag order, sternly warning the former president of the possibility of jail for future violations.

Back in 2020, after Donald Trump lost the presidential election, the official account of the Arizona Republican Party started getting a little... wild.
In late night tweets, they started asking followers if they were ready to die for Trump.

The conclusion from legal analysis here is that prosecutors have a very confused case. They claim that this is fraud, but in state law, the fraud has to have specifically harmed individuals materially. Intent to defraud needs a specific target. They have never ruled for fraud against "the public." Besides, the checks were from 2017, so the concept of defrauding the public in an election is a moot frame.
According to analysis, prosecutors should have delineated that the fraud was specifically against regulators.
There is no basis for "election fraud" legally.
At least for the checks to Cohen, they may be 2017, but the payments Cohen made to Keith Davidson, Stormy's lawyer, were 2016
Late 2016 too
transcript from when the controversial exchange between the judge and a witness
Deliberations going to start now
The media enables his noisy stans by calling it a "hush money case" (not illegal). They get spit-talk energetic about harping on that point.
Here is what it is, in APs recall:
Merchan went over New York’s law against “conspiracy to promote or prevent election,” a statute that’s important to the case. That’s because prosecutors claim that Trump falsified business records in order to cover up alleged violations of the election conspiracy law. The alleged violations, prosecutors say, were hush money payments that really amounted to illegal campaign contributions.
Confirmation bias is a helluva drug. If the jury is instructed to rule with this in mind, they really unfortunately should return a not guilty verdict. You can't insinuate charges for which a defendent hasn't been charged. NYS fraud statutes require specifically naming aggrieved parties. No demographic, much less the general public, has ever once been considered an aggrieved party of fraud under the law. All focus should be on falsification of business documents. Apparently the defense closing args included warning that Trump might go to jail, and they should consider that. That's jury nullification. https://www.axios.com/2024/05/28/trump-trial-defense-attorney-jail-closing-argument
Election fraud harms the electors as a whole. Securities fraud harms the market as a whole. Tax fraud harms the nation as a whole. It seems there are many types of fraud that do not require identifying specific individuals. But I guess these are Federal crimes?
