If you copy their work, and literally just did 1-2-3-4-5-6-7 their step, either 1:1 or just different flavor or look but result same work, then yes they can sue.

But if they in any case, even just avoid 1 step to copy, make it whole new, while copying the rest exactly the same, then they will be safe.

Example: they copied step 1-3-4-5-6-7, but completely rework the step 2 with their own creativity and doesn't work exactly the same as the patent, IE, different result, just that step alone, then it's not infringement.

Of course this is very very simplified logic of it, but should cover the general gist of it

Yes think of it this way. She is originally summoned by Shirou as a Saber. During the events of FGO (which is now canon btw), she is called to the lost belts as a Caster support. In this Summer event (Summer 2023 jp) her Caster version joins Chaldea in her Berserker form

Basically caster artoria summoned as a berserker. Since heroic spirits can take on different classes depending on what lore they take after. Just like how Lancelot from Fate Zero is summoned as Berserker when he could easily be a saber since he was the best swordsman of the knights of the roundtable
