Patents typically have a hierarchy. What palworld is getting sued for are basically three brand new sub patents. Bucky made it abundantly clear that he really cares about the industry so Pocketpair is not gonna let Nintendo establish this precedent.

Nintendo probably didn’t want to risk the higher level patents which weren’t cited in the suit as well as going specifically against Palworld as Craftopia not only predates the upgrades but the higher level ones anyway.

Barring any horrendous governmental corruption this should be a slam dunk case for the defendant, but it’s still gonna take years and substantial capital to fight the good fight.

You can upgrade patents sure, but they are still separate.

Doesnt quite allow adding terms directly, afaict, but allows you to specify a subpatent covering a more specific purpose, thus allowing greater coverage with the patent

For example, the original patent was the capturing in conjunction with a controller, afair. But the childpatent is just the capturing. Thus the child patent is more specific and covering more

There’s prior art ti even craftopia too so it would be nice to see the whole thing erased from Nintendo’s IP but I can’t say if Pocketpair has the resources to drag this out to that extent.

But if Nintendo got humiliated with this one it would be a seminal moment for the industry.
