I think it would be difficult to code around, actually, but I'm not positive on that.
If it's intentional, it's likely because you COULD make or purchase items from the market, already knowing you've got the surcharge price locked in.
it is based on the customer, so asking for anything whether you have it or not triggers the proc chance

Which doesn’t make sense, IMO. They will surcharge for something that you don’t even have in stock, but they won’t surcharge something that you DO have, you just don’t have enough Energy to surcharge it yourself.

It was "bugged" and a few people claimed that it was surcharging everything. But yeah, it's not supposed to surcharge something that you wouldn't normally have the Energy to surcharge yourself.
Which I think is stupid. As the tooltip says nothing about that. Just that customers have a 10% chance to surcharge themselves.
it would enable full bin low energy builds to surcharge T13's, that is not the purpose of the talent
