How would card forfeit work strategically? Aren’t capital attacks often made on a trade meaning the attacking player just shed cards (maybe all of their cards). This mode would just motivate making sure you were low on cards when taking a risky cap roll and wouldn’t really benefit the surviving defending player except in the rare cases of noobs who don’t understand the rules slamming a cap while carrying 3 or 4 cards. Maybe this is how you intended it to work?
Additionally if the failed cap roll is their only attack then the attacking player doesn’t gain a card from taking a territory so they wouldn’t even have that card to surrender to the defending player. I assume the retaliation or card surrender happens at the end of the attackers turn and not immediately upon cap roll fail. If it’s the other way then losing the ability to finish your turn with additional attacks or a fortify after a failed cap roll might be the biggest punishment.
