So i got a car yesterday from a used car dealer, got the buyers receipt, bill of sale, and plates on the car but in less than 24 hours it stopped working. Asked the dealer about a refund and he said it was a used car sold as is and i had the buyers receipt but he didn’t file the title as the dmv was closed yesterday. So the title definitely wasn’t filed when i questioned him so i think i technically don’t have ownership and if i contact my dmv would they help me get a refund? This is in texas. (The issue isn’t bad but its the fact that it was advertised as a (great car) and immediately have issues
#Dealership Refund possibility/issue?

This was my first time getting a car which makes it horrific enough
Ok, so I just had this same exact situation happen to me last month. I got my money back. Immediatley document what is wrong with the car and get proof. That may mean a mechanic diagnosis is needed. However you have to prove that the car would have the issues before you bought the car and they hid it. Look into DTPA laws in texas
Someone with Texas specific experience may chime in with better info, but broadly speaking you likely don’t have much in the way of options. They aren’t obligated to help you or refund for an as-is sale in most cases. You could try getting a lawyer involved, but at that point the law of diminishing returns will apply.
For me, it was the timing chain and my scan tool didnt show it. I was lucky i got a refund because this would have turned into a law suit if i could prove it
But as Charles has actually pulled this off, follow his advice and good luck!
Do you know what is wrong with it?
Honestly the issue massive its just the battery but the fact that beforehand i asked if they can replace/recharge the battery prior and they said it was recharged + told me to drive it for a good 30m was the reason as to why im taking drastic measures just it to fail 5 hours later
yeah, i will say. got super lucky. But in short it will work for all. But hard part is proving that the dealer knew of known issues and did deceptive business practices to sell the car
so it is a dead battery?
Yeah, easy enough but i did not like the lying
I mean it is entirely possible they thought the battery was good but wasnt. Did you buy from a used car dealer or a franchise dealership that had used cars?
A used car dealer, they definitely knew as once i asked them they mentioned it back to me
Without me specifically saying what was the issue just stating it wouldnt run
what is the date on the battery? Dont want to rule out the possibility of an alternator.
Tbh a dead battery is nothing too out of the ordinary. I have def gone to dealers where the battery is dead when i bought it but it was charged and good to go with no issues
Im not currently home atm so can’t Check on it for another few hours sadly but im 90% certain its the battery
Kinda scummy when they had a recharge kit and didnt opt to recharge it for me though
but if you were driving and it died that could be a few things. I will be honest. Just a dead battery isnt a massive cause for concern. It is possible it is having issues holding charge
I believe places like auto zone will test the battery for you to see how good it is.
However what you can do. Is you can reach out to them and let them know the battery died again and ask if they are able to diagnose and replace for you for free.
Not sure they’d replace it for free since they told me interstate sold some
Im planning to buy a recharge kit just to make sure but have w feeling a home kit wouldnt work
it does not hurt to ask. but i would go get your battery tested. it is possible the battery is dying. My old battery in my car would be fine but then just kept failing recharge after recharge. after like 3 jumps i had to go buy a new one
Also the fact that the car has plates but no insurance and registration for the time being makes it a risk to drive
GG @small timber, you just advanced to level 2! Chat more to level up and earn top roles!
Might just have to ask a neighbor to jump my car then risk the drive there
they let you buy the car with out proof of insurance? you should have a temp registration
Oh wait forgot they gave me the plates so i have temp registration mb
Ill go to autozone later today and have them see whats the issue with the battery
yeah, you should be good there. But also usually insurnace you have a grace period
yeah, does not hurt to test. also this sounds dumb. but make sure the grounds are tight. My brother had a draining battery issue but it was loose grounds
what kind of car anyways?
Old car, 2001 chrysler lhs but with 80k miles, good car fax and the major transmission and water pump issue with this fixed/worked on previously
Needed a decent car as an a-b for work since its a security tight area so uber isnt allowed
ah, i mean that also is probably cheap car territory. so that can make it harder too. stuff can go wrong
Yeah true, i’ll just buy/ some jumper cables/ ask a co worker for help jumping it so i can take it to autozone
Pretty certain if i ask they’d take a look at it free of charge no?
i believe it is one of their free services yes. point is to get you in the door to want to buy a new one
