There is a cheat called forced merging.
This is a cheat that allows you to merge with the other player even if they have not set a flag.

People that use any type of private lobby cheat are responsible to make sure they actually don't let anyone else in. You're still held accountable. In the end of the day everyone could just say "Oh I used the code but it didn't work".

this is a scenario where if a normal player (miriam) were to join a player (the alleged hacker) through normal means through "recent opponents"

since they (the hacker) left their join status "ON", the normal player "Miriam" is in for a big surprise.

I left it unedited from start to finish to show I never enabled any "forced entry" cheat as the appealer claims I'm doing

part 3: this is a scenario where a player joins a friend through streetpass! This 3DS will join a player they tagged along somewhere (a.k.a. my room) and sure enough, it happens to be the same room the first 3DS was trying to join (with the hacker)

usual private matchmake codes (such as mine posted here) usually take care of this. that's why i said they're in charge for not making sure their stuff is taken care of properly.

If you join a hacker through "With Friends," you can break into their room even if they're in a private room.

In other words, Juan_MK7 is semi-forcefully joining the hacker through "With Friends and Rivals" and reporting them.

Using cheats through "Anyone in the World" is a violation.

But it's wrong to join a hacker through "With Friends and Rivals" and then say, "This is a public room. Ban it."

It's a very strange and ridiculous story, that just having online publishing turned on would allow people to enter your private room and ban you from using it.
