Its impossible to inforce that rule, They can implement fines but other than that its ineligible to be considered illegal

On some consoles tho ( THIS IS NOT NINTENDO PRODUCTS INCLUDED.) there has been a law set out that makes it illegal if the original owner didnt consent to it, or it wasnt listed as hacked.
