refresh rate - how many times the monitor changes the image (digitally)
response time - how long the actual pixels take to ACTUALLY change.

These things can all be different.
A panel which has a very low response time but a 60hz refresh rate will still have great clarity.

no, its a pcie 5.0 card.. thats why its listed as a "requirement".. but it will work in any pcie x16 slot

and will be unnoticable in a gen4 slot, because games dont even max out the gen4 bandwidth on gpus, nevermind gen5

It's not a criminal trial though. So they could try that, yes, but usually the first step is to try to get the case dismissed. Given how low tech some of what they did is, I think a judge is likely to deny the request and allow for discovery. And that's when they have to turn in at least some documents they would not want out even if they can stall the trial itself afterwards
