I'm out of shape enough (age 60 + n) that I get warm just by getting out of bed and attending to the morning tasks. I put on the heat but keep moving; if required I put on whatever that synthetic wool thing is ('fleece') jacket.

Good question. I don't think they have any immediate legal power, but they might lay out the logic that would cause a similar but not quite identical case to be ruled differently later on.
