They do, but because of that they are banned from certain countries or stores.

Which yeah does not go exactly to that area where it would not be published on the stores themselves, honestly I have no idea. Sony and Microsoft have those rules and you have to follow them, Void does and there is no issue. For some games that don't it means the games just don't release on the stores, or respectively get banned in some areas

The underlying rule is that you need to adhere to these policies if you want to get your game published without issues.
