"The answer won't surprise you" 15 seconds in and I love this episode already

We put it in a pinned comment on the video but I figure I’ll also write it here.
We recorded this episode a day early this week and the palworld Nintendo story didn’t hit until way after we finished recording.

It's just as well, if you release a message that Nintendo has sued Palworld, Nintendo might sue you for copying their message about Nintendo suing Palworld

wicked bluff
#

Have they patented suing Palworld?

cyan coyote
#

Also about the flappy bird predecessor thing, I think they are referring to that they also acquired the rights to Piou Piou vs. Cactus which supposedly is what inspired the flappy bird character in the first place. But as I am sure you guys found out, the information about this whole thing is very muddy. I suspect intentionally so by gametech llc lol

"A man I have only ever learned about against my will," is a phenomenal line, kudos to whomever wrote it.

I'm working as a patent examiner at USPTO (US Patent and Trademark Office) for a few months now, the fact that in the new cyle there's been two articles related to patents and/or trademarks is a very sad day.

#

Fun fact, in the mod slack this is the first episode in which we've instituted a 'checkpoint tips line' channel.

There were 15 different stories handed in before Palworld dropped.

#

Oh, and if any of the LRR crew ask:
I am not legally allowed to speak for the USPTO, and, can be terminated for it.
I could speak abstractly about the process, and provide links to publically available documentation, if anyone cares.

Personally I'd say don't put your job on the line for it but you probably just want to ask Graham if you're so inclined

I'm seeing a lot of people being wrong about patents online in the past 24 hours and it's been painful.

#

Like this sort of thing.

#

My first instinct there is... doesn't it matter more what the Japanese patent rules are since the parties involved are both Japanese companies?

lavish ledge
#

It's half.

#

So, you're correct that it's a different country, they have different laws. However, Japan, like the US, still is apart of the International Patent Cooperation (IPC), so all of their, and our, formating is fairly similar. The way the claim language works is similar, and they've got similar laws. Referencing similar laws is a valid reference point.

#

Most of the time when a company wants broad patent protection, they apply to all of the markets they're interested in (US, EU, China, India, Japan, Korea, and others). So they claim the priority date from a provisional application date from another country. It happens fairly frequently.

#

So if I found a Japanese patent in a company that spans across the world, you would bet that they're also applying that same patent to other countries. The claim language (and independent and dependent claim formating) would be different, and how the individual offices would respond differently, but the specifications would be the same (because, well, specifications are weird).

All of Annapurna Interactive quitting really reminds me of the solidarity and unity of when all of Deadspin quit

blazing shadow

Or The Escapist.

obsidian creek
#

Annapurna resigning just reminds me of what Bryan Cantrill said about Larry Ellison:

Do not fall into the trap of anthropomorphizing Larry Ellison. You need to think of Larry Ellison the way you think of a lawnmower. You don't anthropomorphize your lawnmower, the lawnmower just mows the lawn, you stick your hand in there and it'll chop it off, the end. You don't think 'oh, the lawnmower hates me' -- lawnmower doesn't give a shit about you, lawnmower can't hate you. Don't anthropomorphize the lawnmower. Don't fall into that trap about Oracle.

blazing shadow
#

I said it when the topic came up in #videogames and I'll say it again: Sure, in the tech industry there's people who don't like Google, or Apple, or Microsoft, or Amazon, or etc. Nobody, NOBODY likes dealing with Oracle. They're on a whole other level.

I have to say, the line in the Cameron-written W40k story about "the seductive qualities of fascist aesthetics" really got to me (in the good way) so hard that I'm even sure I can coherently articulate it. Heck, I'm not even sure "got to me" is the right word choice there. I just know I rewound to relisten to that sentence a few times.

Can I just say that I hate you're dunk-quoting right-wing political activists and their talking points. Quoting Charlie Kirk feels different from quoting Amsongold or the CEO, that guy founded a business to profit off political rhetoric.

I had no idea who Larry Ellison was. Is he the like OG tech CEO douchebro?

CEO of Oracle

#

Oracle might be the only company hated by all of their customers and employees

#

He's not any of the various -bro types. He's just an incredibly ruthless business person. Uses every single option available to lock in customers and prevent public criticism

In general, one does not choose to deal with Oracle. One is forced to deal with Oracle.

#

(via legal threat)

Also, stupidly wealthy. He's responsible for driving up the cost of entry to the Americas Cup by throwing millions at the Team Oracle boat, meaning the only entrants now are multi billionaires, massive organisations, or countries.

Or because they undercut their competitors bids - like what happened when Oracle won the bid for Oregon's Health Insurance Marketplace (and then John Oliver sided with Ellison by making fun of the State of Oregon).

idle mountain
#

Ooof

gentle stump
#

Yeah... I refused to watch John Oliver for about 3-4 years after that, because Oliver basically went for the low-hanging fruit of "Let's make fun of Oregon for being weird and hiring Weiden-Kennedy to do a big flashy (and admittedly kinda cringy) ad campaign to get people to sign up for the Oregon Health Insurance Marketplace" instead of "Oracle's software for the Health Insurance Marketplace could not actually handle a scenario where the State of Oregon's efforts to actually promote the marketplace worked and got tons of people to sign up, so the big corporation whose CEO and founder everyone thinks is an asshole F'd up - so let's point at all the ways that tech corporations can undermine and undercut efforts to roll out public services by screwing them up so they don't work while governments and non-profits into their technology."

Has there been updates to the palworld situation? I've only seen a bit but the disc horse seems rough

#

Yes nintendo is being patent trolls but also we kinda should have seen this coming

tall spindle
#

We have 0 details on what the patent is so I'd argue to wait before making declarative comments

simple field
#

Also that. Internet fights be how they are I guess

lavish ledge
#

No.

#

However the prosecution wants to reveal the patents as late as possible during this process, so this is kinda expected.
