Ruggs was initially facing 50+ years after being charged with:
driving under the influence of alcohol and/or controlled or prohibited substance resulting in death
driving under the influence of alcohol and/or controlled or prohibited substance resulting in death or substantial bodily harm
two counts of reckless driving resulting in death or substantial bodily harm
possession of a gun under the influence of alcohol or drugs.
The Clark County DA offered a plea deal to Ruggs mainly because they were incredibly worried that a court would have suppressed the result of the blood draw and the prosecutors would have lost the felony DUI charge. Ruggs accepted the guilty plea deal, bringing those charges down to:
driving under the influence of alcohol and/or controlled or prohibited substance resulting in death
misdemeanor vehicular manslaughter.
Combined, both charges can only result in a maximum of 10 years. The judge literally cannot sentence more than 10.
