So I need Wohnungsgeberbestätigung and sub contract both ? Or subcontract alone also works? In my case ..main tenant has conveyed to me that sub contract should work. No Wohnungsgeberbestätigung is needed. Im confused a bit here
Generally, I haven't seen sublets provide a Wohnunggebersbestätigung because those can only be issued by the landlord/owner. If they are giving you this and it has the tenant's name on it, I do not think that that's legal.
And you need the Bestätigung for your Anmeldung. You can't do it with a contract anymore.
There are instances where the main tenant can ask the landlord to issue the Bestätigung for you, but that is usually only when you are both sharing the apartment and it is big enough to house two (or more) people.
No, the main tenant is the "landlord" in that case and has to give a Wohnungsgeberbestätigung. I've done so many times
The sample form of our city shows it too
The first one is the "giver of the flat" for a sublet it would be me, while the "Eigentümer" (owner) is the landlord
While you're correct in theory, it's a legal requirement to have permission to sublet from the landlord, and many main tenants do not do this, which is why you often see "no Wohnunggebersbestätigung" in conversations with subtenants. In these cases, filling out the Bestätigung as the main tenant is illegal.
That said, I'll recognise that I'm wrong in saying that only the landlord can issue it.
