Disclaimer: I'm not a legal expert.

How is the WG set up in legal terms? Is there one contract holder that subcontracts, or is there a shared contract of all the tenants with the landlord, or what is it like?

By the way, how is it that you don't find a Nachmieter? There's a housing shortage in many parts of Germany. Is the rent for your apartment that high?

Just as a thought... and this is just a thought, you should absolutely ask an expert about this. Might there be a way to establish a situation where the landlord would be incentivised to terminate the contract?

I mean, hypothetically, if you can't cancel the contract, can you stop paying rent or do some other stuff that puts pressure on the landlord? Or bribe him to terminate, or anything? Or to put pressure onto the other tenants? I know it's not nice, but from what I can see, they're not nice about it either. And if they say you're breaking the contract, you might be made to pay (which you would have to do regardless) plus some fine, but if from the start you make it clear enough that you're trouble and just want out, wouldn't they have to accept that eventually?

Again - not a legal expert, and you should definitely not try that without consultation. If done wrong, this might go horribly wrong.

I'd suggest to get a lawyer too. They will definitely listen to your problem and make a first "forecast" on how it might turn out and which steps they'd take. Anwalt für Mietrecht is the right person to talk to

The most common contract, the joint lease where everyone is a "hauptmieter", or at least mieters, can only be terminated by everyone

if you run into problems with looking for a replacement to you, you will be in the same trouble as me

so if you can afford it, PLEASE just get a fucking untermietvertrag, or rent alone

#

and if you choose otherwise, only do it in very big cities, where chances are high

#

Yeah buddy it do be looking bad. Mieterschutzverbund could also help (they're like before lawyers, just giving advice like we are rn but they're experienced a lot). I'm not experienced in rental stuff, but Id also say it's very likely you'd get out of the contract with a lawyer. As you mentioned, there is no reason why anyone would force you to stay in this flat

I would go on like mentioned in the post you sent. Ask your roommates again to agree getting out of the contract or at least changing it to only their name, ask the Vermieter, and threaten all of them with an Anwalt

I mean idk your current living situation but I know how bad it can be. I was stuck in a similar situation two years ago, but with additional d0mestic vi0lenc3 so I managed to get out rather 'fast', but I was also massively harmed and depressed in that time. It took so much energy to get out and fight for my right but it was worth it, looking back it's just another 'challenge' life gave me and I'm proud I got through it, and I feel stronger and smarter (as you already said you're smarter now too)

I won't call anyone's situation worse or better, nor does it matter. If you feel bad with the current situation you should, and you have the right to, do something about it to get into a better place regardless of the 'level of badness'

@vestal crypt I'm sure it has occurred to you you could just find an Untermieter? They wouldn't have to sign the contract in your stead, you'd keep the contract, it would just be somebody else living in your room/s and either paying your share of the rent directly to your flatmates, or to you and you'd keep paying the landlord.

Hmmm I'm being very petty with this suggestion but why not annoy your current roommates until they sign you off the contract?
Make sure that if you have a room it continues to not be used by them. In the very least if you are paying rent you should still have a room. If you don't have a dwelling within the apartment maybe that's the only kinda lawsuit you could possibly do? Germany is definitely different than USA :c All I had to do was pay a cancel fee for breaking the lease. Very sorry for your situation and hope they reconsider signing you off.

Depends on the contract type tbf. Imagine you and me buy a house together, we live there all cool, then I cheat on you and randomly decide my new boyfriend will live in our house with us too. You just sleep in the guest room, I don't really care. And then you think "aight I want to sell the house and go back to where I'm from, back to my mom in... Zimbabwe". We signed the contract together, you can't just go back to the agency and give the house back lmao it's also mine. A lot of lawsuits happen between couples where they'll end up having to pay compensations to the other person and whatnot, but it sometimes takes years or actually drives people into homelessness. And unmarried couples / other forms of living together are seen kinda the same, acting as one lawful 'unit'

It brings some advantages too, if everyone is the proper owner / renter of a place, but more common with WG is just having the flat registered and signed on one person and the others just have a contract with this one person

they can give you not only advice but legal representation if you need it. this kind of stuff rarely goes to court i think and is probably settle-able with a nastygram from a lawyer with a nice letter header
