I know some people who have entirely built their entire avatar from the ground up included model, texture and even custom shader. I'd imagine they'd be very displeased if it was ripped. Heck, even if the only thing custom about an avatar is the colours and textures, that doesn't make it any less stealing.

But that said, reading back, making people jump through home made DRM is not the answer either.
