At that point, I try to invite them to the axis but it tells me I can't invite them because they have to be fascist to be in my faction. Does anyone know why that is and if it's possible to get them into my faction?

for example bohemian empire is 30% i believe while america is like 70% if its a non historical faction

So, you lack the air designer DLC. With base game, "design" is relatively simple, though generally you always crank the engine to +5 when you have the air XP.
