iirc the reasoning is because first of all, just chemical warfare in general is banned, but even if you argue that teargas is 'harmless' enough; in a combat scenario you can't tell whether you're being sprayed with tear gas or "oh frick we're all gonna die" gas.
So its also partially just practical to not use it in the first place.
