Good morning, so I had a look at this. First I wanna make it very clear: The developer got DDOSed because someone did not like them. The bad actor did not DDOS them because they knew the developers would release the server binaries. Them releasing server binaries is the only reason why people can still enjoy this game in multiplayer.

Now I assume your worry is that people start DDOSing random games, to get the developers to shut down the servers, release the server binaries and possibly go bankrupt. I think having this worry is partially justified, but in the long run it doesn't make a difference. People are gonna DDOS your servers for one reason or another. This is something you have to deal with no matter whether server binaries are to be licensed to players or not.

If you are an indie developer, then in this situation this type of client-server architecture is a bad choice. If you cannot deal with a DDOS, no matter the reason, then you have no choice but to switch network architecture or add other security mechanisms. Having a law in place to keep a game playable after release is not gonna change this.

Literally every online game out there can be killed by DDoS. Even AAA studios, with millions invested in cyber security, struggle immensely. But there ain't much direct financial incentive to mount a prolonged large-scale DDoS attack right now. Mandating the release of server binaries, or EoL server builds or anything else to that extent will create such an incentive. And if a proverbial Lazarus Group gets involved, and they absolutely will 'cause now there's a shitload of cash to be made, what has been an occasional short-term attack will become a perpetual full-scale war, that'll kill every online game that doesn't have millions to pour into security every year and severely damage profitability of those that do. A lot of people conflate him focusing on his vision of it being about single player games with always online DRM as him misrepresenting it... Since the initiative has nothing to do with that.

I would say that is more him giving an example of what he would support rather than him describing the initiative but people are taking it as misrepresentation.
