To be clear: I do think this should still be allowed. In an ideal world, to me, anyone can just make a "Pokemon" game or an anything game, the franchises wouldn't belong to anyone, only individual entries would, Touhou-style.

@minor nymph I have a question regarding druids of other games, specifically their Morph ability. Will there be the ability to morph like in other games? If so, will it be Staff exclusive with the classic morphs? Or will anyone be able to do so, with different forms? @minor nymph Sorry to @ ya but just saw this about Japanese patent law. Looks like Japan allows people to patent after the fact that it was invented. Not sure what that means when it comes to in the sense of a court battle. However they clearly can at least obtain it. Now its the courts jobs to find out if its a worthy patent.
"The patent prosecution procedure under Japanese law is similar to that in most other patent systems. Article 39 states that a person who is the first to file an application for a patent for an invention may obtain that patent, rather than a different person who is the first to invent the same invention."

Technically I think this is meant to be about being able to patent the concept vs having to invent it but it also seems to be one of those things that someone can invent something and someone can patent it afterwards

Prior art will have the precedence but it allowed them to just basically troll them with a lawsuit and stir up some grief

Probably thought they could strategically hurt them like Dark and Darker... File the patent, sue em, see if Steam or other platforms delist them until the legal battle is sorted

It is mostly to protect someone from inventing something and applying for a patent, then having someone else say 'I invented this first but kept it **secret **until now HAHAHA'. The purpose of the patent system is to reward and incentivize both invention and telling the world how to perform the invention.
Patent trolling mostly does not rely on this principle. Published prior art can still be used to invalidate a patent.

@minor nymph your video yesterday on the Palworld patents situation could be seen as somewhat misleading. Here is some further context.

Firstly, just reading the abstract of a patent can not tell you if the patent should have been granted. The abstract just gives a rough idea of the supposed invention. The details of the claims determine patentability. Reading the abstract and then deciding that the patent examiner did not properly investigate the prior art is somewhat irresponsible.
In fact, we can look at the examination documents. Here (https://register.epo.org/ipfwretrieve?apn=JP.2024123560.A&lng=en) the European Patent Register has some (somewhat poorly) translated documents from the Japanese examination of the patent looked at in the video.
The document ‘Notice of Reasons for Refusal (TRANSLATED)’ shows the application was initially rejected (not due to the prior art). The examiner noted (page 3) a lot of prior art: previous patents including one from Sony granted in 2014 as well as Youtube videos and articles on Pokémon Go and Monster Hunter.
Despite these, the examiner was convinced that the claims were novel and inventive at the priority date (2021), which is why the patent was eventually granted. Similarly for the other patents listed.
The way the patents were presented by PocketPair was truthful but a little misleading. Some claims take priority from patents filed in 2021. In terms of the law, this can be as if Nintendo had filed the patent application in 2021.
Nintendo first filed these ideas in the 2021 patent application, but simply did not include claims covering this exact embodiment of the idea. They are given time (sometimes 5 years) to apply for further applications based on the material filed in 2021.

In short, do not assume that PocketPair would win in court. It could very well depend on the precise interpretation of a few words in the original Japanese claims that were granted. They might lose outright. Or it may be that some claims of some of the patents are found invalid, some valid but not infringed by Palworld, and some both valid and infringed. None of this is legal advice.
PS: This is not to say that Nintendo is completely in the right, or that patents on game mechanics are a good idea. In fact, there are countries (e.g. New Zealand) which have broadly similar patent law to the US, except they outright do not allow software patents.

Regarding Thor discussing spell casting in AoC, I have a question. I am not the most versed in playing MMO's, but I was wondering if there has ever been an MMO that uses the equivalent of rhythm casting, where you have to hit certain keys at the right time to maximize your casting?

I can't think of one that does. I'm not sure it would be a successful mechanic though. Doing something to a rythym usually requires fairly tight patterns which means low latency or ping. Thats easy for an offline game but not an MMO.
