I've always had this standing theory about the Mandela Effect, hear me out. Imagine reality is like a giant hard drive. When the Earth hits the cosmic reset button (you know, apocalypse-style), maybe it doesn't wipe everything clean. Some data gets deleted, some gets overwritten, but a few memory fragments stubbornly cling on, like that one corrupted file you just can’t delete. So when things reboot, most people get the new patch, but a chunk of us are walking around with weird leftover data from the last version of Earth. Boom, collective deja vu. Basically, we’re all just glitchy meat-robots with memory cache issues.

Nintendo recently updated their End User License agreement for the Nintendo Switch 2. Essentially, if you buy the console, you don’t actually own it. They have made it so that Nintendo retains ownership of each and every console, even if you buy it. What you are actually buying is a “license to use the console”. They install kill switches and stuff into the console so that if you do anything Nintendo doesn’t like, they can brick your console. If you try to open it, mod it, if you stream something they don’t like, you post something they don’t like, they are able to link with your Nintendo account and brick your console because it’s “technically” still “their property”.

Software maybe, but not for hardware. Nintendo is doing this for the actual console itself, the physical thing that you buy, rather than just the web service, online service, or software. Licensing, when done by companies, is supposed to be for services, things that regularly cost the company money to do, something that they need regular income for upkeep. A physical, manufactured product is supposed to be a purchase not a license.

Those clauses were originally meant for anti-cheat on online services. So, if you modded your game, then went onto an online setting and were ruining others’ experience with the service, they could ban you from online. Nintendo’s new EULA is different. It gives them control over your private access and enjoyment of their product. They still own the thing even after you buy it. It is anti-free market, and it takes advantage of the consumer.
