I don't think any merc ships should be MIL. They are by definition not military despite being very heavily armed in some cases. The only two military ship categories are TSF and rogue ships.
Not to mention that the bullshit ADS rule that ALL mil ships regardless of affiliation and degree of hostility are to be immediately killed is frustrating as hell. It's significantly less bad now that we have USSP ships but I still would rather not deal with ADS at all.
