Yeah, the litigiousness is vastly vastly overexagurated. And also, companies don't care to start shit, so they're not actively looking for fan projects to tackle. Pokemon RPG maker fan games were just in a hype of actually marketing their games, some were even ran by actually registered companies (as far as they existed on paper, I guess), and people made trailers. The advice as generally that if you wanted a trailer, you should be prepared to drop your fan game due to a C&D if it picked up steam

honestly I think the broader take away with Polterworx there generally, and that joker specifically, is not about the use of copyrighted stuff at all, it's mostly about community management and the optics of advertising a fan project and related community, and trying to set up anything that resembles anything official. Same thing that seemed to be causing similar issues in the pokémon fangame scene.
