Devs/creators/studios give initial permission for the game to be streamed and therefore profited from by streaming (sometimes blanket permission so no one has to ask, other times express permission needs to be given). The initial permission may be "You can stream and profit from streaming the game as we released it." while additional permission may be needed to legally say "You can stream and profit from streaming the game with modifications."
Then of course management needs to pass on the okay to the streamer

That honestly depends entirely on your personal opinion and how you feel about it, whenever I see any project where the main draw and the way its 'marketed' is that it's supposed to be a '''demake''' or supposed to imitate a game from a certain era or console, mainly PS1, I usually find it's usually not really done that well and it's usually mostly just because they want to do a low poly style project
That specific example of Fuwamoco actually looks pretty convincing, like I mentioned it does remind me a lot of Banjo even the UI looks pretty similar
I think it's fake in the sense that it's an animation not an actual game project being worked on (though the OP made another tweet asking for anyone who might want to help to make it a real thing)
Pseudoregalia I think is another one that comes a bit close to properly conveying how a game from the era its trying to replicate would be like (although stuff like the very low character framerate I think goes too far and looked very weird to me)

the key thing is low poly, specific shading and texture filtering, low res textures, etc. people gladly accept improved framerates and resolution as a compromise when you're already not having an ideal retro experience on a high refresh rate CRT

This topic is really interesting to me, for some reason, because I actually really like the idea of ''it's a PS1 game but with modern game design/modern tech applied to it'' as well as someone trying to legitimately imitate how a PS1 game would operate
so you could essentially make an ''improved'' version of a PS1 game, the problem is when I see some person making ''PS1 horror game'' and it's just a pretty standard first person horror project but it's low poly and everything is pixelated so it's PS1!

The short of it is that during one of her streams a discord message notification popped up which led to a lot of rumors and speculation and hate towards her because people were theorizing it was her boyfriend and this person was also a pretty popular figure and it all got to her really badly and she pretty much leaked company information and other people's information to a japanese drama news channel (?) to try and clear the situation
But that's just the one big part of it, Rushia's entire character in itself just kind of leans towards not exactly being the most healthy thing, which is why I say that all this shouldn't be too surprising
