I have a client who has all the pieces set for active sync but has the need to do a fan out (2 sites continuity - 1 DR) relationship and they keep getting an error to change relationship to mirror-vault... Anyone got any ideas?

yes, only async-mirror and mirror-vault are supported for fanout. See here

right... any clue on how to change the relationship type? The sync mirrors were setup in the gui

I think you need to delete the relationship and re-create it with the correct policy applied, then resync
