3d Secure authentication can be required by card issuers at any time. It hasn't been too common in the US but we are seeing more and more banks requiring it.

Can banks require it across both charges and Payment Intents?

Banks can require it any time a card is used, regardless of the Stripe product.

Charges aren't configured to handle it so we recommend Payment Intents.

If a bank requires it and the user is using charges would the payment fail? Or end up in some sort of error state like we are seeing for the payment which is requiring 3D Secure (which we don't have implemented)

I think it would simply fail and show up in the failure message. Charges weren't designed to handle 3DS.
