I'm afraid that's not customisable, the design here is that payment of the most recent unpaid invoice re-activates the subscription, as you say

you could maybe incorporate a check on your system when in addition to checking the subscriptionstatus, you list open invoices for the customer as well(https://stripe.com/docs/api/invoices/list) and don't give access to your product/service if there are any
