Because it is using the same code for both processing for new payment methods and for pms which are already set up

As the error message suggests, that's the parameter that requires mandate_data to be present too:

When confirming a PaymentIntent with a us_bank_account PaymentMethod and setup_future_usage, mandate_data is required.

However, if you're charging a PM that's already set up, setup_future_usage is not needed.
