Once you have a Payment Method from a Checkout Session in setup mode, you should be able to just set it as the default on the Subscription and charge tax as you normally would. The setup mode version of checkout doesn't create a payment. It just sets up a Payment Method for future usage. From there you have to take an additional step to create a payment (or let your subscription auto-charge the new Payment Method)
