@final trellis no that's not possible unfortunately, it's always triggered in that case and you need to look at the Subscription to decide whether you want to skip that email send or not

The data that comes with that webhook is the old subscription data, so the status is still trialing. I need to make a whole new request to fetch the subscription to grab the latest state?

yep that's what I would do. That or put the Event in a queue and send an email later only if you don't see any new Event since
