I am not a lawyer but I believe the key here is billing address, if it's the US then the payment is considered to be taking place in the US.

Hi Vanya! Thank you for the response. Yes I'm using Stripe checkout.
What do you think the best strategy would be?
Ask for customer's billing address just before Stripe Customer object is created?
Or can we somehow filter the transactions based on the billing address?

Are you collecting the billing address on the Stripe Checkout page or on your website?
