Since a customer is on session/in your checkout flow when you're using Checkout, payment_behavior doesn't really apply here

ah ok, i had assumed this would maybe apply if i was using trials and the first invoice that requires payment failed, is that not the case?

At that point, the subscription becomes past_due if the payment for the first invoice after the trial ends fails
