No you can't set on_behalf_of without having card_payments on a Connected Account

we have legacy_capability for some connected accounts

what will happen if we set it regardless of card_payments

Hmm I'm not positive about how it interacts with legacy_capabilities to be honest.

That is going to take some investigation and you would be best off either testing it (if you can) or giving a full detailed ask to our Support team so they can look into it
