No I don't think that's possible. As you said you need to pass billing_address_collection: 'required' to force the billing address collection. So you need to know before creating the Checkout Session if you want to collect the billing address or not.
Also note that you can't completely disable the billing address. When using billing_address_collection: auto, some payment method will still require the billing address.

Mh, okay. Do you know if this will be changed in future maybe ? I think that will be helpful also for others to use the already-built checkbox to define if its a business or not and then require some extra data, like their billing address
