I downloaded the game agreed to terms and services and it only shows a “new game” option. Is it because I accepted the terms and services or is it something else?

because it doesn't use steam cloud

you need to manually copy the save data and put it on a flash drive or cloud storage yourself

C:\Users\[user]\AppData\Roaming\DarkSoulsIII

just copy the file and put it on a flash drive or on google drive/onedrive/etc, same as you would any other file
