There's some things I've noticed and I'm not sure if there deliberate such as say my character has block breaking gear but there fighting someone higher fused the chance to break block will be less, and debuffs such as cripple seem to last hardy any time if I do it to someone stronger

Here’s the thing. Your team is probably at a good fusion level now. Your EQs however are still very low fusion, and you don’t have many rares. Even if you do, they’re still at low fusion. So you choose a mode like fatal battles. The disadvantages are on your side.
