This move compared to others is not broken at all from the number of unfair things that love water and thunder have

The Halloween bda being straight up unfair and string pull
And infinites

This moves is nothing compared to those

just make it like 30% for 20 secs and u can't breathe for 10, lucky if you get that, halloween counter lasts like 10 secs, if it was 70% for 40 secs that would just too broken
