Using the modded skill while flying recovers incorrect amount of power it seems.

I have observed that on Positive Attitude the power recovery can happen a second or two after. Did you check that?

Wait I think the issue is it doesn't work right when flying, but on ground it works....

What's happening, I think, is that the power recovery happens immediately on the server, but the client is notified only when receiving some "status update". In combat, that would happen immediately, so hopefully it's not an issue.

Tested it out on ground floor it's recovering my power...

I tested too. If I start flying, and use Positive Attitude, I don't get the power it's supposed to give, until I land. Then I get it on the first power regen tick.
So basically it puts the +power on queue with power regen, and since you don't regen when flying you get the +power a long time after you used the ability. A bit of a nerf for flying people, good enough for everyone else. Probably not a bug...
