Well, it's sort of a yes and no. No big publisher owns them in any shape or form and they got their money and budget from the previous few prototype games and the early access.
And if BG3 flopped Larian would have already shuttered their doors.
So just for the studio and background definition they are definitely indie. Or were before BG3 success at least.
I like that definition of indie more than the "yo, we're Microsoft/Sony/etc but we let one of our game studios make a game that looks indie because we hear that sells well" approach
