It is not stealing if you redraw it. Good job so far! Let’s try understanding what is happening there.
What I would suggest: try tracing the original a bit to understand how it works.
The downside is that the reference is not helpful. The body has a big lens deformation, fisheye effect. And it is very hard to reproduce.
The photo is based on that cool fisheye effect, but let’s try using that pose just as a inspiration and not as a ‘study’. In this case we will have to rebuild the figure.
